E. Noise Control <br /> Unless otherwise approved, construction involving noisy operations, including starting and <br /> warming up of equipment, shall be restricted to the hours between 7:30 A.M. and 4:30 P.M. on <br /> weekdays, and to the hours between 8:30 A.M. and 4:30 P.M. on Saturday. Noisy operations <br /> shall be scheduled to minimize their duration and to ensure their completion by 4:30 P.M. <br /> except for work required to be performed as specified outside the time restrictions. <br /> The Contractor shall comply with applicable laws, regulations, and ordinances which apply to <br /> any work performed pursuant to the contract. If the requirements of this section are more <br /> restrictive than those of the local regulations, the requirements of this section shall govern. <br /> Each internal combustion engine, used for any purpose on the job or related to the job, shall be <br /> enclosed and be equipped with a muffler of a type recommended by the manufacturer. No <br /> internal combustion engine shall be operated on the project without said muffler and enclosure. <br /> Contractor shall be required to locate all fixed construction equipment such as compressors and <br /> generators as far as feasibly possible from sensitive receptors. Contractor shall shroud or shield <br /> all impact tools. <br /> Where possible, the Contractor shall use electric rather than diesel or gas-powered equipment. <br /> There shall be no start-up of machines or equipment, no delivery of materials or equipment, no <br /> cleaning of machines or equipment and no servicing of equipment except during the permitted <br /> hours of construction involving noisy operations. <br /> Amplified sound and other forms of loud communication constituting a nuisance, at the sole <br /> discretion of the Engineer, shall not be permitted. <br /> If at any time during the performance of the work the noise limits are exceeded, the Contractor <br /> shall take immediate corrective actions through equipment modification, addition of noise <br /> abatement equipment, or modify construction-operating procedures. <br /> F. Water Pollution Control and Sediment Control <br /> The Contractor shall conform to the regulations and requirements of the City and legally <br /> authorized surface water management agencies. As a minimum, Contractor shall comply with <br /> General Construction Activities Storm Water Permit as adopted by the State Water Resources <br /> Control Board for construction sites of one acre or more. <br /> The City has filed a Notice of Intent to be covered under the General Construction Activities <br /> Storm Water Permit. As a condition of the permit, Contractor is required to prepare a Storm <br /> Water Pollution Prevention Plan detailing Best Management Practices (BMPs) for the <br /> minimization of storrnwater runofff effects to the surrounding ditches, storm drains, and <br /> detention basins. Contractor prepared Storm Water Pollution Prevention Plan shall comply with <br /> requirements of the General Construction Activities Storm Water Permit, and with additional <br /> provisions contain in these Special Provisions.
