e. The Contractor shall inform the body awarding the contract of the location of the records <br /> enumerated under Paragraph (a) including the street address, city and county, and shall, <br /> within five working days, provide a notice of a change of location and address. <br /> f. In the event of noncompliance with the requirements of this Article, the Contractor shall <br /> have ten days in which to comply subsequent to receipt of written notice specifying in what <br /> respects the Contractor must comply with this Article. Should noncompliance still be <br /> evident after the ten-day period, the Contractor shall, as a penalty to the State or political <br /> subdivision on whose behalf the Contract is made or awarded, forfeit $25.00 dollars for <br /> each calendar day, or portion thereof, for each worker, until strict compliance is effectuated. <br /> Upon the request: of the Division of Apprenticeship Standards or the Division of Labor <br /> Standards Enforcement, these penalties shall be withheld from progress payments then <br /> due. Responsibility for compliance with these Paragraphs (a) through (f) lies with the <br /> Contractor. <br /> Attention is directed to Sections 1777.5, 1777.6 and 1777.7 of the California Labor Code and <br /> title 8, California Administrative Code Section 200 et seq. To insure compliance and complete <br /> understanding of the law regarding apprentices, and specifically the required ratio thereunder, <br /> the Contractor (and subcontractors) should, where some question exists, contact the Division of <br /> Apprenticeship Standards prior to commencement of the work. Responsibility for compliance <br /> with this Paragraph 9 lies with the Contractor. The City's policy is to encourage the <br /> employment and training of apprentices on its construction contracts as may be permitted <br /> under local apprenticeship standards. <br /> The Contractor shall comply with all applicable provisions of Section 1810 to 1815, inclusive, of <br /> the California Labor Code relating to working hours. The Contractor shall, as a penalty to the <br /> owner, forfeit $25.00 for each worker employed in the execution of the Contract by the <br /> Contractor or by any subcontractor for each calendar day during which such worker is required <br /> or permitted to work more than eight hours in any one calendar day or 40 hours in any one <br /> calendar week, unless such worker receives compensation for all hours worked in excess of <br /> eight hours at not less than 1-1/2 times the basic rate of pay. <br /> a. In accordance with the provisions of Section 1860 of the California Labor Code, the <br /> Contractor's attention is directed to the requirement that in accordance with the provisions <br /> of Section 3700 of the California Labor Code, every Contractor will be required to secure <br /> the payment of compensation of his or her employees. <br /> b. In accordance with the provisions of Section 1860 of the California Labor Code, each <br /> Contractor to whom a public works contract is awarded shall sign and file with the awarding <br /> body the following certification prior to performing the work of the Contract: "I am aware of <br /> the provisions of Section 3700 of the Labor Code which requires every employer to be <br /> insured against liability for worker's compensation or to undertake self-insurance in <br /> accordance with the provisions of that code, and I will comply with such provisions before <br /> commencing the performance of the work of this Contract." <br /> PROTECTION OF WORKERS IN TRENCH EXCAVATIONS <br /> As required by Section 6705 of the California Labor Code and in addition thereto, whenever <br /> work under the Contract involves the excavation of any trench or trenches five feet or more in <br /> depth, the Contractor shall submit for acceptance by the City or by a registered civil or structural <br /> engineer, employed by the City, to whom authority to accept has been delegated, in advance of <br /> excavation, a detailed plan showing the design of shoring, bracing, sloping, or other provisions <br /> July 2007 Division IV-4 NEI Phase II Water and Sewer <br /> CIP Nos. 7468, 7589, 7590 <br />
