GUARANTEE <br /> FOR THE <br /> CITY OF TRACY <br /> Tracy, California 95376 <br /> NORTHEAST INDUSTRIAL PHASE II WATER AND SEWER PROJECT <br /> CIP Nos. 7468, 7589, 7590 <br /> We hereby guarantee that the work we have installed for the NORTHEAST <br /> INDUSTRIAL PHASE II WATER AND SEWER PROJECT, CIP Nos. 7468, 7589, 7590 has <br /> been done in accordance with the Plans and Specifications and that the work installed will fulfill <br /> the requirements of the guarantee. <br /> We agree to repair or replace any or all of our work, together with any other adjacent <br /> work which may be displayed in so doing that may prove to be defective in its workmanship or <br /> material within a period of one (1) year from the date of acceptance of the above-named work <br /> by the City of Tracy, without any expense whatsoever to the City of Tracy, ordinary wear and <br /> tear and unusual abuse or neglect excepted. <br /> Within fifteen (15) clays after being notified in writing by the City of Tracy of any defects <br /> in the work, we agree to commence and prosecute with due diligence all work necessary to <br /> fulfill the terms of this guarantee, and to complete the work within a reasonable period of time, <br /> and in the event of our failure to so comply, we collectively and separately, do hereby authorize <br /> said City of Tracy to proceed to have such work done at our expense and we will honor and pay <br /> the cost and changes therefore upon demand. <br /> Dated: <br /> By: <br /> July 2007 Division IV-20 <br /> NEI Phase II Water and Sewer <br /> CIP Nos. 7468, 7589, 7590 <br />
