CONTRACT BOND - MAINTENANCE <br /> CITY OF TRACY Bond Number <br /> Tracy, California 95376 <br /> Whereas, the City Council of the City of Tracy, State of California, and <br /> (hereinafter designated as "Principal') have entered into an agreement whereby principal <br /> agrees to install and complete certain designated public improvements, which said Agreement, <br /> dated 20_, and identified as: NORTHEAST INDUSTRIAL <br /> PHASE II WATER AND SEWER PROJECT, CIP Nos. 7468, 7589, 7590 is hereby referred to <br /> and made a part hereof; and <br /> Whereas, the Principal is required under the terms of said agreement to furnish a good <br /> and sufficient maintenance bond for the faithful performance of said agreement pursuant to <br /> Government Code Sections 66499.1., 66499.4. and 66499.9. and Tracy Municipal Code <br /> Section 12.36.080, and -- <br /> Whereas, Principal has constructed various public improvements: <br /> in accordance with the General Conditions, the Drawings and Specifications, which Plans are <br /> by reference incorporated herein, and made a part hereof, and is referred to as the Plans. _ <br /> NOW, THEREFORE, the condition of this obligation is such that, if Principal shall remedy any <br /> defects due to faulty materials or workmanship, and pay for any damage to other work resulting <br /> there from, which shall appear within a period of one (1) year from the date of substanti lthis <br /> completion of the work provided for in the Plans, namely, until <br /> obligation to be void; otherwise to remain in full force and effect. _ <br /> IN WITNESS WHEREOF, the Principal has duly e2eecuted this instrument and Surety <br /> above named, on — <br /> Principal Bonding Company <br /> NEI Phase II Water and Sewer <br /> July 2007 <br /> Division IV-21 CIP Nos. 7468, 7589, 7590 <br />
