(e) Resection of Bids Containing Alterations Erasures or Irregularities: Bids may be rejected if <br /> they show any material alterations of form, additions not called for, conditional or alternative <br /> bids, incomplete bids, erasures or irregularities of any kind. — <br /> (f) Bidder's Guaranty: All bids shall be presented under sealed cover and shall be accompanied <br /> by cash, cashier's check, certified check, or bidder's bond, made payable to the City of Tracy <br /> for an amount equal to at least ten (10%) percent of the amount of said bid, and no bid shall be <br /> considered unless such cash, cashier's check, certified check, or bidder's bond is enclosed <br /> therewith. — <br /> (g) Award of Contract: All bids will be compared on the basis of the Engineer's Estimate of <br /> quantities of work to be done. The award of the Contract, if awarded, will be to the lowest _ <br /> responsible bidder based upon the Total Base Bid Price, whose bid complies with all the <br /> requirements described herein. The award, if made, will be within One Hundred Twenty (120) <br /> calendar days after opening the bids. The City anticipates faxing the Notice of Award to the <br /> Contractor the day after it is awarded by the City Council. <br /> This project will require the acquisition of an easement prior to being awarded by the City _ <br /> Council. As such, no date has yet been established for the award of contract and the bidder's <br /> proposal shall be guaranteed for a period of 120 days following the bid opening. <br /> (h) Execution of Contract: The Contract agreement shall be signed by the successful bidder and - <br /> returned together with the contract bonds and proof of required insurance within ten (10) <br /> calendar days after the bidder has received written "Notice of Award" that the Contract has <br /> been awarded. Failure to return said Contract agreement, contract bonds and proof of <br /> required insurance within ten (10) calendar days might be considered breach of Contract. No <br /> bid shall be considered binding upon the City until the execution of the Contract is fully <br /> executed by all parties to the Contract. — <br /> In the event that a bidder breaches the contract by failing to execute a Contract and file <br /> acceptable bonds and insurance as provided herein within ten (10) calendar days, after the _ <br /> bidder has received "Notice of Award" that the Contract has been awarded, the proposal <br /> guaranty shall be forfeited to the City. Upon the full execution of the Contract agreement, the <br /> City will issue written "Notice to Proceed". _ <br /> (i) Return of Bidder's Guarantees: Fifteen (15) days after the award of the contract, the City Clerk <br /> will, upon request, return the bid guarantees accompanying each of the bids which are not to <br /> be considered in making the award. All other bid guarantees will be held until the contract has <br /> been finally executed, after which they will be returned to the respective bidders whose <br /> proposals they accompany. <br /> (j) Project Schedule and Order of Work: The Contractor shall submit to the Engineer a <br /> practicable progress schedule within ten (10) calendar days of the written "Notice to Proceed", <br /> and within five (5) calendar days of the Engineer's written request at any other time. The <br /> schedule shall incorporate the target completion date for all phases of work; shall reflect all <br /> staging sequences required for construction activities in accordance with provisions of the <br /> project plans and specifications; and shall demonstrate the order in which the Contractor _ <br /> proposes to carry out the work, including the dates on which several salient features of the <br /> work will start (including procurement of materials, plant and equipment) and the contemplated <br /> date for completing the said salient features. <br /> July 2007 Division 1 -4 NEI Phase II Water and Sewer — <br /> CIP Nos. 7468, 7589, 7590 <br />
