SECTION 3: AWARD AND EXECUTION OF CONTRACT <br /> Issue Date: December 11,2006 <br /> Section 3, "Award and Execution of Contract," of the Standard Specifications is amended by adding the following <br /> section after Section 3-1.02,"Contract Bonds": <br /> 3-1.025 INSURANCE POLICIES <br /> • The successful bidder shall submit: <br /> 1. Copy of its commercial general liability policy and its excess policy or binder until such time as a policy is <br /> available, including the declarations page, applicable endorsements,riders, and other modifications in effect at the <br /> time of contract execution. Standard ISO form No.CG 0001 or similar exclusions are allowed if not inconsistent <br /> with Section 7-1.12,"Indemnification and Insurance." Allowance of additional exclusions is at the discretion of the <br /> Department. <br /> 2. Certificate of insurance showing all other required coverages. Certificates of insurance, as evidence of required <br /> insurance for the auto liability and any other required policy, shall set forth deductible amounts applicable to each <br /> policy and all exclusions that are added by endorsement to each policy. The evidence of insurance shall provide that <br /> no cancellation,lapse,or reduction of coverage will occur without 10 days prior written notice to the Department. <br /> 3. A declaration under the penalty of perjury by a certified public accountant certifying the accountant has applied <br /> Generally Accepted Accounting Principles(GAAP)guidelines confirming the successful bidder has sufficient funds <br /> and resources to cover any self-insured retentions if the self-insured retention is$50 000 or higher. <br /> • If the successful bidder uses any form of self-insurance for workers compensation in lieu of an insurance policy, it <br /> shall submit a certificate of consent to self-insure in accordance with the provisions of Section 3700 of the Labor Code. <br /> Section 3-1.03,"Execution of Contract,"of the Standard Specifications is amended to read: <br /> 3-1.03 EXECUTION OF CONTRACT <br /> • The contract shall be signed by the successful bidder and returned, together with the contract bonds and the <br /> documents identified in Section 3-1.025, "Insurance Policies," within 10 business days of receiving the contract for <br /> execution. <br /> Section 3-1.04, "Failure to Execute Contract,"of the Standard Specifications is amended to read: <br /> 3-1.04 FAILURE TO EXECUTE CONTRACT <br /> • Failure of the lowest responsible bidder,the second lowest responsible bidder,or the third lowest responsible bidder <br /> to execute the contract as required in Section 3-1.03, " Execution of Contract," within 10 business days of receiving the <br /> contract for execution shall be just cause for the forfeiture of the proposal guaranty. The successful bidder may file with the <br /> Department a written notice, signed by the bidder or the bidder's authorized representative, specifying that the bidder will <br /> refuse to execute the contract if it is presented. The filing of this notice shall have the same force and effect as the failure of <br /> the bidder to execute the contract and furnish acceptable bonds within the time specified. <br /> SECTION 5:CONTROL OF WORK <br /> Issue Date: December 31,2001 <br /> Section 5-1.02A,"Trench Excavation Safety Plans,"of the Standard Specifications is amended to read: <br /> 5-1.02A Excavation Safety Plans <br /> • The Construction Safety Orders of the Division of Occupational Safety and Health shall apply to all excavations. <br /> For all excavations 1.5 in or more in depth,the Contractor shall submit to the Engineer a detailed plan showing the design <br /> and details of the protective systems to be provided for worker protection from the hazard of caving ground during <br /> excavation. The detailed plan shall include any tabulated data and any design calculations used in the preparation of the plan. <br /> Excavation shall not begin until the detailed plan has been reviewed and approved by the Engineer. <br /> • Detailed plans of protective systems for which the Construction Safety Orders require design by a registered <br /> professional engineer shall be prepared and signed by an engineer who is registered as a Civil Engineer in the State of <br /> Contract No. 10-0M7104 <br /> 8 <br />
