<br /> • No plan shall allow the use of a protective system less effective than that required by the Construction Safety
<br /> Orders.
<br /> • If the detailed plan includes designs of protective systems developed only from the allowable configurations and
<br /> slopes, or Appendices, contained in the Construction Safety Orders, the plan shall be submitted at least 5 days before the
<br /> Contractor intends to begin excavation. If the detailed plan includes designs of protective systems developed from tabulated
<br /> data, or designs for which design by a registered professional engineer is required, the plan shall be submitted at least 3
<br /> weeks before the Contractor intends to begin excavation.
<br /> • Attention is directed to Section 7-1.O1E,"Trench Safety."
<br /> SECTION 7: LEGAL RELATIONS AND RESPONSIBILITY

<br /> The eighth paragraph of Section 7-1.09, "Public Safety"of the Standard Specifications is amended to read:
<br /> • Signs,lights,flags,and other warning and safety devices and their use shall conform to the requirements set forth in
<br /> Part 6 of the California MUTCD. Signs or other protective devices furnished and erected by the Contractor, at the
<br /> Contractor's expense, as above provided, shall not obscure the visibility of, nor conflict in intent, meaning and function of
<br /> either existing signs, lights and traffic control devices or any construction area signs and traffic control devices for which
<br /> furnishing of, or payment for, is provided elsewhere in the specifications. Signs furnished and erected by the Contractor, at
<br /> the Contractor's expense,shall be approved by the Engineer as to size,wording and location.
<br /> The fourteenth paragraph of Section 7-1.09, "Public Safety,"of the Standard Specifications is amended to read:
<br /> • The Contractor shall notify the Engineer not less than 18 days and no more than 90 days prior to the anticipated start
<br /> of an operation that will change the vertical or horizontal clearance available to public traffic(including shoulders).
<br /> The sixteenth paragraph of Section 7-1.09, "Public Safety,"of the Standard Specifications is amended to read:
<br /> • When vertical clearance is temporarily reduced to 4.72 in or less, low clearance warning signs shall be placed in
<br /> accordance with Part 2 of the California MUTCD and as directed by the Engineer. Signs shall conform to the dimensions,
<br /> color, and legend requirements of the California MUTCD and these specifications except that the signs shall have black
<br /> letters and numbers on an orange retroreflective background. W12-2P signs shall be illuminated so that the signs are clearly
<br /> visible.
<br /> Section 7-1.O1A(6), "Workers'Compensation,"of the Standard Specifications is amended to read:

<br /> Section 7-1.12,"Indemnification and Insurance,"of the Standard Specifications is amended to read:
<br /> 7-1.12 INDEMNIFICATION AND INSURANCE
<br /> • The Contractor's obligations regarding indemnification of the State of California and the requirements for insurance
<br /> shall conform to the provisions in Section 3-1.025, "Insurance Policies," and Sections 7-1.12A, "Indemnification," and
<br /> 7-1.12B, "Insurance,"of this Section 7-1.12.
<br /> 7-1.12A Indemnification
<br /> • The Contractor shall defend, indemnify, and save harmless the State, including its officers, employees, and agents
<br /> (excluding agents who are design professionals) from any and all claims, demands, causes of action, damages, costs,
<br /> expenses, actual attorneys' fees, losses or liabilities, in law or in equity (Section 7-1.12A Claims) arising out of or in
<br /> connection with the Contractor's performance of this contract for:
<br /> 1. Bodily injury including, but not limited to, bodily injury, sickness or disease, emotional injury or death to persons,
<br /> including, but not limited to, the public, any employees or agents of the Contractor, the State, or any other
<br /> contractor;and
