The final determination of claims will be sent to the Contractor by hand delivery or deposit in the U.S. mail. The <br /> Engineer will then make and issue the Engineer's final estimate in writing and within 30 days thereafter the State will pay the <br /> entire sum, if any,found due thereon. That final estimate shall be conclusive and binding against both parties to the contract <br /> on all questions relating to the amount of work done and the compensation payable therefor,except as otherwise provided in <br /> Sections 9-1.03C, "Records,"and 9-1.09,"Clerical Errors." <br /> • Failure of the Contractor to conform to the specified dispute procedures shall constitute a failure to pursue diligently <br /> and exhaust the administrative procedures in the contract and shall operate as a bar to arbitration in conformance with the <br /> requirements in Section 10240.2 of the California Public Contract Code. <br /> SECTION 12: CONSTRUCTION AREA TRAFFIC CONTROL DEVICES <br /> Issue Date: October 6,2006 <br /> The second paragraph of Section 12-1.01, "Description,"of the Standard Specifications is amended to read: <br /> • Attention is directed to Part 6 of the California MUTCD. Nothing in this Section 12 is to be construed as to reduce <br /> the minimum standards in these manuals. <br /> Section 12-2.01, "Flaggers,"of the Standard Specifications is amended to read: <br /> • Flaggers while on duty and assigned to traffic control or to give warning to the public that the highway is under <br /> construction and of any dangerous conditions to be encountered as a result thereof, shall perform their duties and shall be <br /> provided with the necessary equipment in conformance with Part 6 of the California MUTCD. The equipment shall be <br /> furnished and kept clean and in good repair by the Contractor at the Contractor's expense. <br /> The first paragraph of Section 12-3.01, "General,"of the Standard Specifications is amended to read: <br /> In addition to the requirements in Part 6 of the California MUTCD, all devices used by the Contractor in the <br /> performance of the work shall conform to the provisions in this Section 12-3. <br /> The fifth paragraph of Section 12-3.01,"General,"of the Standard Specifications is amended to read: <br /> • Retroreflective sheeting shall conform to the requirements in ASTM Designation: D 4956 and to the special <br /> provisions. <br /> The first paragraph of Section 12-3.06, "Construction Area Signs,"of the Standard Specifications is amended to read: <br /> • The term "Construction Area Signs" shall include all temporary signs required for the direction of public traffic <br /> through or around the work during construction. Construction area signs are shown in or referred to in Part 6 of the <br /> California MUTCD. <br /> The fourth paragraph of Section 12-3.06, "Construction Area Signs,"of the Standard Specifications is amended to read: <br /> • All construction area signs shall conform to the dimensions,color and legend requirements of the plans,Part 6 of the <br /> California MUTCD and these specifications. All sign panels shall be the product of a commercial sign manufacturer, and <br /> shall be as specified in these specifications. <br /> The eighth paragraph of Section 12-3.06, "Construction Area Signs,"of the Standard Specifications is amended to read: <br /> • Used signs with the specified sheeting material will be considered satisfactory if they conform to the requirements <br /> for visibility and legibility and the colors conform to the requirements in Part 6 of the California MUTCD. A significant <br /> difference between day and nighttime retroreflective color will be grounds for rejecting signs. <br /> Section 12-3.06A, "Stationary Mounted Signs," of the Standard Specifications is amended by deleting the third, fourth, <br /> fifth,and sixth paragraphs. <br /> Contract No. l 0-OM7104 <br /> 17 <br />
