Yermlf Section <br /> ENCROACHMENT PERMIT <br /> GENERAL AND SPECIAL PROVISIONS <br /> 1. This Permit is issued under and subject to all laws and ordinances of agencies governing <br /> any encroachment herein permitted. See, e.g., San Joaquin County,Ordinances Title 10— <br /> Streets and Highways. <br /> 2. Permittee accepts the provisions of this Permit,provided that Permittee's execution of this <br /> Permit shall not be deemed a waiver by Permittee of any preexisting real property or <br /> other rights Permittee may have to use or occupy the land that is the subject of this <br /> Permit. The grant of this Permit shall be for a term of two years from the date of issuance <br /> . but may be suspended by written notice from the County during the pendency of any <br /> material violation of the provisions of this Permit or applicable County ordinances that <br /> imperils the safety of County's facilities or populace. <br /> 3. All road restoration work shall be done in accordance with the Specifications (as that <br /> term is defined in the MOA) and subject to the County's reasonable satisfaction, <br /> inspection, and acceptance as provided in Section 3.2 of the MOA. Permittee shall at all <br /> times during the progress of the work keep the County Highway in as neat and clean a <br /> condition as is possible and, upon completion of the Work, shall leave the County <br /> Highway in a thoroughly neat, clean, and usable condition. <br /> 4. Permittee shall properly maintain any encroachment structure placed by Permittee on any <br /> part of the County Highway and promptly repair any injury to any portion of the highway <br /> that occurs as a result of the maintenance of the said encroachment structure until such <br /> time as County may relieve Permittee of such maintenance responsibility. <br /> 5. Permittee shall repair, at its own expense, any damage to County's improvements that <br /> result from Permittee's work performed pursuant to this Permit. <br /> 6. No material used for fill or backfill in the construction of any encroachment shall be <br /> borrowed or taken within the County right-of-way. <br /> 7. All work shall be planned and carried out so that there will be as little inconvenience as <br /> possible to the traveling public and in a manner that facilitates the future safety and <br /> convenience of the traveling public. No material shall be stacked within eight feet (8') of <br /> the edge of the pavement or traveled way unless otherwise provided herein.
