Resolution 1540 October10,2024 <br />WHEREAS,the Commission specificallyconsidered the factordescribed in Government <br />Code Section 56668(k),the abilityof the City of Stockton to provide the servicesthatare the subject <br />of the applicationto the annexation area;and <br />WHEREAS,the CEQA Commission held a public hearing on the proposed reorganization <br />on September 12,2024 in the Board of Supervisors Chambers,44 North San Joaquin Street,6d' <br />Floor,Stockton,CA,pursuant to notice of hearing which was published,posted and mailed in <br />accordance with Statelaw;and <br />WHEREAS,at said hearing the Commission heard and received evidence,both oral and <br />writtenregarding the proposal,and allpersons were given an opportunityto be heard;and <br />WHEREAS,the Commission has,in evaluatingthe proposal considered the reportsubmitted <br />by the Executive Officer,the factorssetforthin Section 56668 of the CaliforniaGovernment Code <br />and testimony and evidence presented at the public hearing held before and on September 12,2024. <br />NOW,THEREFORE,the San Joaquin Local Agency Formation Commission DOES <br />HEREBY RESOLVE,DETERMINE,AND ORDER as follows: <br />Section 1.The Mariposa IndustrialPark I,Phase 2 Reorganization isas shown on <br />Attachment 1 of thisresolution. <br />Section 2.Certifiesthat,as a Responsible Agency,the Commission has independently <br />reviewed and considered the Final Environmental Impact Report (SCH#2020120283)and concurs <br />with the findingsof the Addendum to the FEIR and adequacy of the MMRP as certifiedby the City <br />of Stockton. <br />Section 3.The Reorganized Property is a threepercent (3%)increasein projectacreage <br />of the scope of the FEIR for the Mariposa IndustrialPark I Project (SCH#2020120283)and the <br />increase in acreage is de minimis.Pursuant to CEQA Guidelines 15062(a)(1),there are no <br />substantialchanges associatedwith MIP I,Phase 2 which willrequiremajor revisionsof the MIP I <br />FEIR due to the involvement of new significantenvironmental effectsor a substantialincreasein <br />the severityof previouslyidentifiedsignificanteffects. <br />Section 4.Finds that the proposal is uninhabited pursuant to State Government Code <br />Section 56079.5. <br />Section 5.Finds thatno writtenprotestswere receivedby any landowner or registered <br />voter within the projectarea. <br />Section 6.Pursuant to CaliforniaGovernment Code Section 56663,the commission waives <br />protestproceedings pursuant to StateGovernment Code Part 4 (commencing with Section 57000). <br />Section 7.Pursuant to CaliforniaGovernment Code Section 56668.3,the Commission <br />considered allpertinentfactorsassociatedwith the Mariposa IndstrialPaark I,Phase 2 reorganization <br />to the City of Stockton and the reorganizationis hereby conditionallyapproved subject to the <br />conditionsof the San Joaquin Department of Environmental Health.
