Per R.S. 33-60. The presumed southerly right-of-way
of S.P.R.R. was established by extending the right-of-way line as
shown on that certain Parcel Map filed for record on December 7,
1989, in Book 16 of Parcel Maps, at page 154, San Joaquin County
Records. P.M. 16-154 showed the railroad right-of-way to be 50
feet wide. It was later determined that the railroad right-of-
way is 55 feet wide. A subsequent survey (R.S. 33-148) accepted
found monuments establishing a parallel line to the railroad
tracks as the southerly right-of-way of the S.P.R.R. property.
The two monuments set near the S.P.R.R. right-of-way line per
R.S. 33-60 are tied to the actual S.P.R.R. right-of-way line as
follows:
1. The westerly monument was set North 29°22157" West 6.29
feet from its true location on the southerly S.P.R.R.
right-of-way line.
2. The easterly monument was set North 29022157" West 6.28
feet from its true location on the southerly S.P.R.R.
right-of-way line.
3
