Permission to Enter Agreement <br /> Advanced GeoEnvironmental, Inc., ("Advanced"), does hereby agree as follows: <br /> This Permit applies to soil remediation and construction and maintenance of a <br /> monitoring well on property owned by County of San Joaquin located at Well Site#2, CSA 12, <br /> Thornton, California, as depicted on Exhibit 1, ("Property"). Advanced Geo Environmental, Inc., <br /> (hereinafter"Advanced"), is permitted to enter, remediate soil and construct and maintain a <br /> monitoring well at its own cost, on Property owned by County.Advanced agrees to not extend, <br /> replace or modify said allowed activity and use without County's prior written approval. Upon <br /> County request,Advanced must remove well at its own expense. At the time of County's <br /> request,Advanced agrees that it has no right to Property, well or any other structure on <br /> Properly. <br /> Advanced agrees to the following conditions of access to Property: <br /> 1.To make requests for access during regular County working hours, Sam Spm <br /> Monday-Friday. <br /> 2. To provide a minimum of 48 hour notice, prior to the commencement of drilling <br /> operations. <br /> 3. To provide a minimum of 24 hour notice, prior to the commencement of soil sampling <br /> activities. <br /> 4.To provide adequate security during drilling operations and soil sampling activities. <br /> 5.To destroy Monitoring well for this remediation project and to restore property to its <br /> original condition,at Advanced's sole cost and expense under permit for San Joaquin <br /> County Environmental Health when no longer required. Reasonable wear and tear is <br /> excepted. All restoration shalt be performed in a good and workmanlike manner. <br /> 6. To comply with all applicable laws and obtain all the necessary permits for the <br /> construction, operation and demolition of the well. <br /> Requests for access and advance notice of activities shall be made to: <br /> S.J. Utilities Maintenance Division <br /> Attn: Ron Rall <br /> Utilities Maintenance Superintendent <br /> 209-468-3090 <br /> Advanced hereby acknowledges the County's planned Thornton Water Storage Tank <br /> Project("Project")which will construct water system improvements on the Property. Advanced <br /> agrees to locate the proposed monitoring well and soil boring in a location which does not <br /> conflict with County's planned improvements,as depicted on the Improvement Plans for the <br /> Project, which have been provided to Advanced. Advanced shall submit to County,for <br /> approval, a plan which indicates the proposed locations of the monitoring well and soil boring <br /> prior to commencement of any drilling activities. Final location of said monitoring well and soil <br /> boring shall be approved by County. <br /> Advanced hereby agrees it will never institute any action or suit at law or equity against <br /> the County of San Joaquin, (hereafter"County), its officers, directors,agents or employees nor <br /> institute, prosecute;or in any way aid in the institution or prosecution of any claim,demand, <br /> action, or cause of action for damage, loss or injury either to person or property, or both,in <br />
