connection with or arising under any work done on Property and for any other activity or
<br /> accident on Property connected with and/or related to said well or soil remediation.
<br /> Advanced shall indemnify and hold County herein and its officers, directors, and
<br /> employees harmless from any and all liabilities, losses, suits, claims,judgments,fines,
<br /> penalties,demands or expenses, including all reasonable costs for investigation and defense
<br /> thereof(including but not limited to attorneys'fees, court costs and expert fees), claimed by
<br /> anyone by reason of injury or damage to persons or property sustained in or about the well.
<br /> Advanced shall obtain and maintain a broad form of Commercial General Liability Insurance to -
<br /> cover the well and Property providing coverage for bodily injury and property damage liability,
<br /> with combined single limits of not less than $1,000,000 per occurrence. Commercial(Business)
<br /> Automobile Liability insurance,endorsed for"any auto"with combined single limits of not less
<br /> than $1,000,000. Workers' Compensation Insurance as required under the California Labor
<br /> Code. A certificate of insurance must be provided naming the County as an additional insured
<br /> and provide County with a 30-day cancellation notice provision.
<br /> Advanced acknowledges and affirms that they have read the contents of this Permit,
<br /> and that they understand the terms hereof. Advanced assumes all responsibility and risk
<br /> associated with any and all activity that Advanced, its agents, contractors,consultants or
<br /> employees participate in,and assume all responsibility and liability in performing any and all
<br /> activity related to and/or associated with the work performed by Advanced, its agents,
<br /> contractors, consultants,employees on Property.
<br /> Advanced acknowledges and agrees that the terms outlined herein are contractual, and .
<br /> agree that the Permit shall be governed by and interpreted in accordance with the laws of the '
<br /> State of California.This agreement shall be binding upon and inure to the benefit of the
<br /> successors, assigns, heirs and legatees.
<br /> The term of this Permit to Enter, commences on c and continues thereafter;
<br /> for a period of one year and will be extended for successive ohb year periods, by Advanced
<br /> notifying County in writing, (60)days prior to termination. Notwithstanding the foregoing, it is
<br /> understood that the County reserves the right to cancel and terminate this Permit to Enter, in
<br /> whole, prior to the expiration of the term hereof, in the event the County determines, in its
<br /> absolute discretion to so terminate the Permit to Enter granted hereunder, by notifying j
<br /> Advanced in writing(60)days prior to termination. Upon such notice of termination Advanced
<br /> shall vacate the Property and surrender all rights in and to the Property and the Permit to Enter
<br /> herein described and will restore the Property as described in Condition#5.
<br /> This Permit contains the entire understanding of the parties hereto with respect to the
