It is understood and agreed by the Pe-mi—Ltee that the performance ofanywork undeLthis permit shall constitute an acceptance of ailtheprovisionscontainedhereinandfailureonthePeiifee's part to comply with any provision will be ca?se for revocation of this permitExceptasotherwiseprovidedforpublicagenciesandfranchiseholders,this permit is revocable on frvcdays notice. <br />3. All work shall be done subject to the supervision ofand the satisfaction ofthe grantor. The Permittee shallat al times during the progessoftheworkkeeptheCountyHighwayinas-Deaf andcleancondition as is possible and upon completion ofthe work authorized hereiishallIeavetheCountyHighwayinathoroughlyneat,clean and usable condition. <br />4. The Ptrniitree also agrees by the acceptance ofthis permit to properly maintain any encroachment structure placed by the Permiitet om anypat,of the County Highway and to immediately repair any damage to any portion of the highway,which occurs as a result of the <br />maintenance ofthe said encroachment structure,until such time as the Puttee may be relieved ofthe responsibLt,for such maintenancebytheCountyofSanJoaquin. <br />5. The PermitLee also agrees by the acceptance ofthis permit to make,at its.own expense,such rtpairs as may be deemed necessary by theCountyDepartmentofPublicWorks. <br />6. It is further agreed by the Permittee that whenever construction;reconstruction or maintenance wort:upon the highway is necessary,theinstallationprovidedforhereinshall,upon request ofthe County Department ofPublic'Works,be immediately moved or removed by andatthesoleexpenseofthePermittee. <br />7 No material used for Ell or backfill in the construction ofthe encroachment shall be borrowed or taken from within the County r,ht ofway. <br />8. Al work shall be planned and carred out with as little inconvenience as possible to the traveling public,-.No material shall be stackedwithineightfeet(8')'ofthe edge ofthe pavement or traveled way unless otherwise provided herein. Adequate provision shall be made fortheprotectionofthetravelingpublic. Tra 5c control standards shall be utilized including barricades;approved signs and lights;andflagmen,as required by the particular work in progress. <br />9. The Permittee,by the acceptance of this permit shall assume fullresponsibility for all liability for_personal injury or damage to propertywhichmayariseoutoftheworkhereinpermittedorwhichmayariseoutofthefailureofthepartofthePermitttetoproperlyperformtheworkprovidedunderthispermit. In the event any claim ofsuch liability is made against the County of San Joaquin or any departmentoricialoremployeethereofthePermitteeshalldefend,indemnify,and hold each ofthem harmless for such claim <br />10. All backfill material is to be moistened as necessary and thoroughly compacted with mechanical means.lirequired by the County DirectorofPublicWorks,such bacic[ll shall consist of gra,cl or crushed rock The Permittee shall maintain the surface over structures placed <br />hereunder as may be.necessary to insure the return ofthe roadway to a completely stable condition and until relieved of such responsibilitybytheCountyDeparunentofPublicWorks.'Wherever a gravel_ crushed rock or asphalt surface is removed or damaged in flat course of <br />work related to the permitted encroachment such material shall either bt separately stored and replaced in the roadway as nearly aspossibleinitsoriginalstateorshallbereplacedinkind,and the roadway shall be left in at least as good a condition as it was bEfore thecommencementofoperationsofplacingtheencroachmentstructure. <br />11.
