The Perm_rtf:ee· also _agrees by the acceptance ofi:h.is permit to properly maintain any encroachment structure-placed by the Pemrittee mi. auy <br />part of the County Highway and to immediately repair any damage to any portion of the highway, which occurs as a result of the <br />maintenan.ce of the said encroachment structure, until such time as the Per:arittee may be relieved of the responsibility for such maim:enance <br />by the Coun.tyofSanJoaquin. · <br />5. The Permittee also agreecS by the acceptance ofi:h.is pern:ri:t to make, .ai its own expense, such repairs as may-be deemed necessary by the <br />Coun.ty Department of Puhifc Works. <br />6. It is further agreed by the Permittee that whenever construction, reconstructiou .or rnaiuteuance work upon the mg:b_way is necessa.--y, the <br />installation provided for herein shall, upon request of the Coun1y Depariment of Pclilic Works, be immediately moved or removed by and <br />atthe sole expense ofthePermittee. <br />7. No material used for fill or backfill in the construction of the encroachment shall be borrowed or taken from wi:thin the Collll.tyright of <br />·way. <br />&. All work shall b~ planned and earned out with as little incoii.venien.ce as possible to ilie traveling public. No :material shall be stacked <br />within eight feet (8') of the edge of the pavement or traveled way unless otherwise provided herein. Adequate provision shall be made for <br />the protection of the traveling public. Traffic control stand:rrds shall he ub.lized including barricades; apprnved signs and lights; and <br />flagmen, as required by the particular work in progress. - <br />9. The Permittee, by the acceptance of this permit, shall assume full respm:isibiliiy for all liability for personal injury or damage to property <br />which may arise out of tlie work her:en; permi:tted or which. may arise out of the failure of the part of the Permittee to pro_perly perform the <br />work provided under this permit In 1he event any claim of such liability £:i m.ade against the County of San. Joaquin or any department, <br />official or employee thereof, the Permittee-shall defend, indemnify, and hold each offuemharrnless for such claim. <br />1 0. All backfill material is to be moistened as necessary and thoroughly compacted. witli. mechanical means. Wherever a grave~ cn:u;hed rock or asphalt suriace is rnmoved or damaged in the course of <br />work related to the permitted encroachment, such material shall either be separately stored and replaced in the roadw_ay as nearly as <br />possible in its original sta,."il or shall be replaced in kind, and the roadway shall be left in at least as good a concfiiion as it was before the <br />co=encement of operatioUB of placing the encroachment structure. <br />11. Whenever it becomes necessary to secnre permissi on from abutting property owners fo:r the proposed work, such aulhority must be secured <br />by the Pemri1.i:ee prior to starting work. <br />12. The curren.t an.d future safety and convenience of the traveling public shall he given every ·consideration in 1he location and methods of <br />coustrucrion utilized. <br />13. The Perniittee is responsible for the preservation of Slli-Vey mom1ments locai"ild within the area of work herein per:mitteci Prior to the s"i.art <br />.of construction, survey monll.illcnfs that potentially may be disturbed sbtll he located an.d rnferenced by a Licensed Land Su..~.;eyor, and a <br />Comer Record filed with the County Su,-veyor. .Any Sm·vey Monuments disturbed during the course of construction shall be reestablished <br />by a Licensed Land Surveyor and another Comer Record filed with 1:be County Surveyor.
