February 15, 2010 ENVIRON vitiv T HEALTH PERMIT/SERVICE; California Office of Emergency Services EPCRA Coordinator 3650 Schriever Ave Mather, CA 95655 RE: Emergency and Hazardous Chemical Inventory Reporting, Section 312 of SARA Title III for Report Year 2009 To Whom It May Concern: Pursuant to the requirements of Sections 312 of the Federal Emergency Planning and Community Right -to -Know Act (EPCRA), 42 U.S.C. §§ 11022, I am writing to submit chemical inventory and emergency planning information relevant to certain facilities owned or operated by AT&T Mobility LLC. Section 312(a) requires owners or operators of facilities having chemicals subject to the OSH Act's MSDS requirements to provide a chemical inventory to the governing SERC, LEPC, and local fire department by March 1 for the chemicals stored on-site above the Federal thresholds during the preceding calendar year (42 U.S.C. § 11022(a)). Although Hazardous Material Business Plans (HMBPs) are completed throughout the calendar year for the local CUPAs or fire departments, AT&T Mobility owns or operates facilities in your jurisdiction that are subject to the annual Federal Tier I1 reporting requirements. These facilities store sulfuric acid, and, in some instances, lead and/or diesel in quantities exceeding the annual Federal reporting thresholds. Therefore AT&T Mobility is providing you with the Tier II reports for these facilities for reporting year 2009. These reports do not replace the HMBPs the local CUPAs or fire departments require.
