• r 1 3, Defendants with actual or constructive knowledge of this injunction,only in so far as they are 2 doing business in the State of California, in the course of defendant's FORKLIFT SALES, RENTAL, SVC 3 activities, are pursuant to Health and Safety Code Chapter 6.95 hereby permanently enjoined from: 4 a. Violating Health and Safety Code §25503,5(a), being a business that handles a hazardous 5 material or a mixture containing a hazardous material that has a quantity at any one time during the reportin 6 year equal to, or greater than, a total weight of 500 pounds, or a total volume of 55 gallons, or 200 cubic feet 7 at standard temperature and pressure for compressed gas, including but not limited to ACETYLENE, 8 PETROLEUM, OXYGEN, WASTE OIL, and failing to establish and implement a business plan for 9 emergency response to a release or threatened release of a hazardous material; 10 b. Violating Health and Safety Code §25504(b), business plan fails to include emergency 11 response plans and procedures in the event of a reportable release or threatened release of a hazardous 12 material, including but not limited to the following: 13 1. Immediate notification to the San Joaquin County Office of Emergency Services 14 and to the appropriate local emergency rescue personnel; 15 2. Procedures for the mitigation of a release or threatened release to minimize any 16 potential harm or damage to persons, property, or the environment; 17 3. Evacuation plans and procedures, including immediate notice, for the business 18 site; 19 c. Violating Health and Safety Code §25504(c), being a business that fails to train all new 20 employees and provide annual training, including refresher courses, for all employees in safety procedures i 21 the event of a release or threatened release of a hazardous material, including, but not limited to, familiarity 22 with the plans and procedures specified in Health and Safety Code §25504(b); 23 1 d. Violating Health and Safety Code §25505(a)(1), being a business that fails to submit a 24 business plan for emergency response to a release or threatened release of hazardous material in accordance 25 with the requirements of Health and Safety Code Chapter 6.95, Article 1; 26 e.
