I handler has included, and maintains as current, in the business plan, all other information required by Health <br /> 2 and Safety §25504. <br /> 3 4. Defendants with actual or constructive knowledge of this injunction, only in so far as they are <br /> 4 doing business in the State of California, in the course of defendant's FORKLIFT SALES, RENTAL,SVC <br /> 5 activities,are pursuant to Business and Professions Code § 17204 hereby permanently enjoined from: <br /> 6 a. Violation of Chapter 6.95, of the Health and Safety Code described in paragraph 3 -3e <br /> 7 above. <br /> 8 5. Defendants shall pay to plaintiff the sum of FIVE HUNDRED DOLLARS ($500.00), as and for <br /> 9 civil penalties, pursuant to Business and Professions Code §§ 17200 et seq.. Said payments shall be made <br /> 10 payable to the TREASURER OF SAN JOAQUIN COUNTY and delivered to the San Joaquin County <br /> I 1 Office of the District Attorney, Environmental Prosecutions Unit, on or before December 1, 2006. <br /> 12 6. Defendants shall pay to plaintiff the sum of FIVE HUNDRED DOLLARS ($500.00), as and for <br /> 13 civil penalties, pursuant to Health & Safety Code §§25514 and 25515.2. Said payment shall be due and <br /> 14 payable to the following in accordance with Health and Safety Code §§ 25514 and 25515.2: <br /> 15 San Joaquin County Office of the District Attorney$250.00 <br /> 16 San Joaquin County Office of Emergency Services$250.00 <br /> 17 1 Said payments shall be delivered to the Office of the San Joaquin County Office of the District Attorney, <br /> 18 Environmental Prosecutions Unit, on or before December 1, 2006. <br /> 19 7. Defendants shall pay to plaintiff the sum of THREE HUNDRED DOLLARS ($300.00), for <br /> 20 partial cost of investigation incurred by the San Joaquin County Office of Emergency Services. Said <br /> 21 payments shall be made payable to the SAN JOAQUIN COUNTY OFFICE OF EMERGENCY SERVICES <br /> 22 and delivered to the San Joaquin County Office of the District Attorney, Environmental Prosecutions Unit, <br /> 23 on or before August 1, 2006. <br /> 24 8. Defendants shall additionally pay to plaintiff the sum of SIX HUNDRED DOLLARS ($600.00), <br /> 25 for partial cost of investigation and suit incurred by the San Joaquin County Office of the District Attomey, <br /> 26 Said payment shall be due and payable to and delivered to the San Joaquin County Office of the District <br /> 27 Attorney, Environmental Prosecutions Unit, on or before August 1, 2006. <br /> 28 <br /> 3. <br />
