ENE)ciECEIVED <br /> 1 are doing business in the State of California, in the course of 4efMdant°s Rif' AURANT&BAR <br /> 2 activities, are pursuant to Health and Safety Code Chapter 6.95 hereby permanently enjoined from: <br /> 3 a. Violation of Health and Safety Code §25503.5(a), being a business that handles a <br /> 4 hazardous material or a mixture containing a hazardous material that has a quantity at any one time <br /> 5 during the reporting year equal to, or greater than, a total weight of 500 pounds, or a total volume of <br /> 6 55 gallons, or 200 cubic feet at standard temperature and pressure for compressed gas, including but <br /> 7 not limited to CARBON DIOXIDE, failed to establish and implement a business plan for emergency <br /> 8 response to a release or threatened release of a hazardous material for all locations listed below in <br /> 9 paragraph 10; <br /> 10 b. Violation of Health and Safety Code §25504(6), business plan failed to include <br /> 11 emergency response plans and procedures in the event of a reportable release or threatened release of <br /> 12 a hazardous material, including but not limited to the following: <br /> 13 1. Immediate notification to the San Joaquin County Office of Emergency <br /> 14 Services and to the appropriate local emergency rescue personnel; <br /> 15 2. Procedures for the mitigation of a release or threatened release to minimize <br /> 16 any potential harm or damage to persons,property, or the environment; <br /> 17 1 3. Evacuation plans and procedures, including immediate notice, for the <br /> 18 business site; <br /> 19 c. Violation of Health and Safety Code §25504(c), failed to train all new employees <br /> 20 and annual training, including refresher courses, for all employees in safety procedures in the event <br /> 21 of a release or threatened release of a hazardous material, including, but not limited to, familiarity <br /> 22 with the plans and procedures specified in Health and Safety Code §25504; <br /> 23 d. Violation of Health and Safety Code §25505, failed to submit a business plan for <br /> 24 emergency response to a release or threatened release of hazardous material for the year 2005 for all <br /> 25 locations listed below in paragraph 10, to the San Joaquin County Office of Emergency Services. <br /> 26 Further, it is alleged that said violation was knowingly committed after reasonable notice; <br /> 27 e.
