1 \ <br /> (a) The Department shall evaluate the PEA report for <br /> adequacy in satisfying Department requirements. <br /> (b) Within ninety (90) days after receiving the report, <br /> the Department shall provide to Respondents written comments <br /> regarding any deficiencies in the report. <br /> (c) Within thirty (30) days of the date the Department <br /> issues its comments, Respondents shall submit a second draft of <br /> the PEA report for evaluation. <br /> (d) If the Department determines that the report is <br /> inadequate and cannot be completed within the allocated budget of <br /> 150 hours, Respondents shall pay an additional PEA fee. <br /> (e) Respondents shall continue to revise the PEA report <br /> until Department requirements are satisfied. <br /> 3 . 5 Statutory Fees. Respondents agree to pay fees <br /> pursuant to Section 25343 of the Health and Safety Code (enacted <br /> as part of Chapter 1286 of Stats. 1990) when such fees are due in <br /> accordance with State law. <br /> (a) Respondents shall pay the fee of $7898 <br /> prescribed by Section 25343 of the HSC for oversight of the PEA <br /> by the Department. <br /> (b) Should the PEA recommend that remediation activities <br /> are required at the Site, a Site size determination will be <br /> conducted, if necessary, to establish the fees for future <br /> activities imposed by Section 25343 . <br /> (c) Respondents shall pay all fees pursuant to Section <br /> 25343 of the Health and Safety Code (enacted as part of Chapter <br /> 1286 of Stats. 1990) required to investigate and remedy all <br /> -9- <br />
