RECEIVED <br /> AL 215216 <br /> DNIN JUHUUIN UUUN IY <br /> 1 material or a mixture containing a hazardous material that has a quantity at any one YMMUMERe"ffil <br /> 2 year equal to, or greater than, a total weight of 500 pounds, or a total volume of 55 gallons, or 200 cubic feet <br /> 3 at standard temperature and pressure for compressed gas, including but not limited to CARBON DIOXIDE, <br /> 4 and failing to establish and implement a business plan for emergency response to a release or threatened <br /> 5 release of a hazardous material; <br /> 6 b. Violating Health and Safety Code §25504(b), business plan fails to include emergency <br /> 7 response plans and procedures in the event of a reportable release or threatened release of a hazardous <br /> 8 material, including but not limited to the following: <br /> 9 1. Immediate notification to the San Joaquin County Office of Emergency Services <br /> 10 and to the appropriate local emergency rescue personnel; <br /> 11 2. Procedures for the mitigation of a release or threatened release to minimize any <br /> 12 potential harm or damage to persons,property, or the environment; <br /> 13 3. Evacuation plans and procedures, including immediate notice, for the business <br /> 14 site; <br /> 15 c. Violating Health and Safety Code §25504(c),being a business that fails to train all new <br /> 16 employees and provide annual training, including refresher courses, for all employees in safety procedures i <br /> 17 the event of a release or threatened release of a hazardous material, including, but not limited to, familiarity <br /> 18 with the plans and procedures specified in Health and Safety Code §25504(b); <br /> 19 d. Violating Health and Safety Code §25505(a)(1),being a business that fails to submit a <br /> 20 business plan for emergency response to a release or threatened release of hazardous material in accordance <br /> 21 with the requirements of Health and Safety Code Chapter 6.95, Article 1; <br /> 22 e. Violating Health and Safety Code §25505(e)(2), being a business that fails to annually <br /> 23 submit a form,provided by the San Joaquin County Office of Emergency Services, that certifies that the <br /> 24 handler has included, and maintains as current, in the business plan, all other information required by Health <br /> 25 and Safety§25504. <br /> 26 4. Defendants with actual or constructive knowledge of this injunction, only in so far as they are <br /> 27 doing business in the State of California, in the course of defendant's RESTAURANT SERVICES <br /> 28 activities, are pursuant to Business and Professions Code § 17204 hereby permanently enjoined from: <br /> 2. <br />
