The receiving facility refused to accept some of the <br />containers of used oil filters since several filters in each drum were not punctured to remove all of the free flowing <br />used oil. Alberto stated that he then hauled the rejected containers of oil filters to 6299 E WEST RIPON RD, <br />MANTECA, CA 95337. Alberto then went through the drums of oil filters and processed the filters which were not <br />punctured by puncturing them and draining out the used oil. The used oil generated by the punctured oil filters was <br />placed in his used oil truck on site and he hauled it off site without using a hazardous waste manifest. Alberto said <br />that the used oil generated at this address was mixed with other used oil. The other used oil was picked up from his <br />customers and manifested from the customer's addresses. <br />Several containers of used oil, punctured oil filters and un -punctured oil filters were observed at this address. <br />Alberta Hernandez could not provide hazardous waste manifests for hauling used oil generated at 6299 E WEST <br />RIPON RD, MANTECA, CA 95337. <br />Alberto Hernandez could not provide hazardous waste manifests for hauling not punctured oil filters and the free <br />flowing used oil within the fihers from his customer's addresses to 6299 E WEST RIPON RD, MANTECA, CA <br />95337. <br />A generator shall prepare a Uniform Hazardous Waste Manifest on EPA Form 8700-22 prior to the transport of a <br />hazardous waste for off-site transfer, treatment, storage or disposal. Ensure that a manifest is prepared each time <br />hazardous waste is transported for off site transfer, treatment, storage or disposal. <br />This is a Class II violation. <br />114 <br />CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. <br />Copies of uniform manifests for the disposal of hazardous waste for the past three years were not found on site. <br />Hazardous waste generators shall retain copies of all manifests signed off by the disposal facility on site for three <br />years and have them readily available for review. <br />This is a Class II violation. <br />119 <br />HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. <br />Copies of hazardous waste disposal records for the past three years were not found on site.
