The Spill Prevention, Control, and Countermeasure(SPCC)Plan does not follow the order or requirements in 40 CFR Part 112, and a cross-reference was not provided. If you do not follow the sequence specified in 40 CFR 112 for the Plan, you must prepare an equivalent Plan and supplement it with a section cross-referencing the location of requirements in 40 CFR 112 and the equivalent Plan. Immediately amend the SPCC Plan to include a cross-reference or to follow the required sequence. This is a repeat violation, Class ll. 603 CFR 112.7(a)(3)Failed to adequately describe the physical layout of the facility in the Plan. 1)The plan inaccurately describes the tanks as containing storage capacities as 15,000 gallons and the map indicates the storage capacities for the same tanks as 20,000 gallons. 2)The facility diagram is missing the location of the waste diesel 55 gallon drum. 3)The facility diagram is not identifying the underground storage tanks(UST)as exempt. The Spill Prevention, Control, and Countermeasure(SPCC) Plan shall include a facility diagram which must mark the location and contents of each fixed storage container and the storage area where mobile or portable containers are located. It must identify the location of and mark as"exempt'underground tanks. It must also include all transfer stations and connecting pipes, including intra-facility gathering lines. Immediately update the facility diagram to include all of the required information. Submit a legible copy of the updated facility diagram to the EHD for review. This is a repeat violation,Class II. 604 CFR 112.7(a)(3)(i)Plan failed to include oil type and storage capacity for each container. The SPCC plan inaccurately describes the aboveground tank volumes.The SPCC plan also did not address the 55 gallon drum storage.The following shall be addressed in the Spill Prevention,Control, and Countermeasure(SPCC) Plan: -type of oil in each fixed container and its storage capacity. For mobile or potable containers,the type of oil and storage capacity for each container or an estimate of the potential number of mobile or portable containers,the types of oil,and anticipated storage capacities. Immediately amend the SPCC Plan to include all required information. This is a repeat violation,Class ll. 608 CFR 112.7(a)(3)(v) Plan failed to address disposal methods for recovered materials. The plan was missing the contact information for hazardous waste contractors. The following shall be addressed in the Spill Prevention, Control,and Countermeasure(SPCC)Plan: -contact list and phone numbers for the facility response coordinator, National Response Center, cleanup contractors,and all appropriate Federal, State, and local agencies. Immediately amend the SPCC Plan to include all required information. This is a minor violation.
