If you do not follow the sequence specified in 40 CFR 112
for the Plan, you must prepare an equivalent Plan and supplement it with a section cross-referencing the location of
requirements in 40 CFR 112 and the equivalent Plan. Immediately amend the SPCC Plan to include an accurate
cross-reference or to follow the required sequence.
This is a minor violation.
605 CFR 112.7(a)(3) Plan failed to address facility layout, operations discharge prevention methods and containers.
The emergency contact list in the SPCC Plan lists the phone number for the San Joaquin County Environmental
Health Department (EHD) as (209) 468-3451. The November
2015 inspection was conducted in December (on December 1, 2015). The only annual inspection report on site is
dated February 19, 2013. The November 2014 through May 2015 inspection reports are not signed by a supervisor or
inspector. The monthly inspection records for January 2014 through October 2014 and for June 2015 were not
available on site. Inspections and tests must be conducted in accordance with the written procedures developed in
the Spill Prevention, Control, and Countermeasure (SPCC) Plan. Records of these inspections and tests must be
signed by the appropriate supervisor or inspector and kept on site with the SPCC Plan for a period of three years.
Immediately locate a copy of all inspection and testing records for the last three years, maintain them on site, and
submit copies to the EHD.
This is a Class II violation.
