The Professional Engineer(PE)certification is incomplete. The page for the PE certification did not have a PE signature or seal,for the copy of the SPCC plan found at the"aggregate"facility, dated May 2017.The copy of the SPCC plan found at the"ready mix"facility had a PE certification but was last reviewed in 2013. Both plans included tanks for both facilities. The PE certification must include all of the aspects in 40 CFR 112.3(d)(1), including attesting that the PE is familiar with 40 CFR Part 112, he or his agent has visited and examined the facility, the Spill Prevention, Control, and Countermeasure(SPCC) Plan has been prepared in accordance with good engineering practice, including consideration of applicable industry standards, procedures have been established for required inspections and testing, and the Plan is adequate for the facility. Immediately obtain a complete PE certification for the facility's SPCC Plan. Submit a copy of the completed certification to the EHD. This is a Class II violation. 203 CFR 112.3 Failure to implement the SPCC Plan. The SPCC plan states that"Appendix E" will contain a list of environmental emergency coordinators and their phone numbers. No such list was observed in "Appendix E"of the plan. The SPCC plan states that a warning sign would be placed at fueling areas, reminding drivers not to depart until all hoses are disconnected and fuel pump is turned off.A sign similar to the one described in the SPCC plan was not observed at the fueling areas of wither facility. The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter"SPCC Plan"or"Plan")," in accordance with § 112.7 and any other applicable section of this part. Implement the SPCC plan as written or amend to plan to reflect current practices and procedures. This is a minor violation. 301 CFR 112.5(a) Failed to amend Plan as necessary. The SPCC plan describes four 250 gallon single walled new oil tanks and some 55 gallon drums as being in a shed, the plan also states that all open top secondary containment structures are under roofed structures.The 250 gallon tanks and 55 gallon tanks are no longer in a shed and the open top secondary containment structure is not under a roofed structure. The Spill Prevention, Control, and Countermeasure(SPCC)Plan must be amended when there is a change in the facility design, construction, operation, or maintenance that materially affects its potential for a discharge,within 6 months of the change, and implemented as soon as possible, not later than 6 months following preparation of the amendment. Immediately make all necessary amendments to the SPCC Plan to accurately represent the procedures and policies currently in place at the facility. This is a minor violation.
