You must ensure that diked areas are sufficiently impervious to contain
discharged oil. Dikes, containment curbs, and pits are commonly employed for this purpose. You may
also use an alternative system consisting of a drainage trench enclosure that must be arranged so that
any discharge will terminate and be safely confined in a facility catchment basin or holding pond.
A facility of this storage capacity must have Spill Prevention Control and Counter Measures(SPCC) Plan
certified by a licensed Professional Engineer. I am not a licensed Professional Engineer. I do not have a
copy of the facility SPCC Plan. However it may be helpful to contact Ramos Oil Company Incorporated.
Ramos Oil Company Incorporated is required to have a SPCC Plan per 40 CFR 112. It is for a licensed
Professional Engineer to certify whether or not this wall is considered to be a dike, and/or a containment
structure, that is designed to hold the fluids of the largest tank within a confined area per 40 CFR 112.
Another suggestion would be to consider if the tanks at this facility are double wall or single wall. If
Ramos installed double wall tanks, then any release from the primary compartment of a double wall tank
would be contained within the secondary containment/interstitial space of the double wall tank.
....and see below in green.
Aris Cacapit, REHs
San Joaquin County Environmental Health Department
1868 E.
