CLEMENTS March 14, 2018 SUMMARY OF VIOLATIONS (CLASS I, CLASS II, or MINOR - Notice to Comply) Item # Remarks 301 CFR 112.5(a) Failed to amend Plan as necessary. In the site's Spill Prevention, Control, and Countermeasure (SPCC) Plan, on section 8.3.3 Integrity Testing Schedule, it mentions that the site is undergoing a site review on October 2016, and once the site review is completed, that the plan will be amended with integrity testing schedule. The plan has not been amended to include that information at this time. The Spill Prevention, Control, and Countermeasure (SPCC) Plan must be amended when there is a change in the facility design, construction, operation, or maintenance that materially affects its potential for a discharge, within 6 months of the change, and implemented as soon as possible, not later than 6 months following preparation of the amendment. Immediately make all necessary amendments to the SPCC Plan to accurately represent the procedures and policies currently in place at the facility. This is a minor violation. 603 CFR 112.7(a)(3) Failed to adequately describe the physical layout of the facility in the Plan. The facility diagram is missing the location of the second five -thousand gallon extender oil tank located in the Rubber AC area. The Spill Prevention, Control, and Countermeasure (SPCC) Plan shall include a facility diagram which must mark the location and contents of each fixed storage container and the storage area where mobile or portable containers are located. It must identify the location of and mark as "exempt" underground tanks. It must also include all transfer stations and connecting pipes, including intra -facility gathering lines. Immediately update the facility diagram to include all of the required information. Submit a legible copy of the updated facility diagram to the EHD for review. This is a Class II violation. 604 CFR 112.7(a)(3)(i) Plan failed to include oil type and storage capacity for each container. The Spill Prevention, Control, and Countermeasure (SPCC) Plan failed to include the second five -thousand gallon extender oil tank located in the Rubber AC area. The following shall be addressed in the Spill Prevention, Control, and Countermeasure (SPCC) Plan: - type of oil in each fixed container and it's storage capacity. For mobile or potable containers, the type of oil and storage capacity for each container or an estimate of the potential number of mobile or portable containers, the types of oil, and anticipated storage capacities - discharge prevention measures including procedures for routine handling of products - discharge or drainage controls such as secondary containment, equipment, and procedures for the control of a discharge - countermeasures for discharge discovery, response, and cleanup - methods of disposal of recovered materials - contact list and phone numbers for the facility response coordinator, National Response Center, cleanup contractors, and all appropriate Federal, State, and local agencies. Immediately amend the SPCC Plan to include all required information. This is a minor violation.
