Failed to conduct periodic inspection of aboveground storage tanks (AST). Section 3.1 states visual inspections are performed monthly and files are kept at the main office of the facility. Each owner/ operator shall conduct periodic inspections of storage tanks to assure compliance with CFR Part 112. SPCC Plan lacks written description of how inspection are conducted and how often. Correct by providing written procedures, conducting regular inspections and maintain documents with the Plan on site for a minimum of 3 years. Submit copies of all of 2013 monthly inspections to EHD. 103. Failed to file business plan or annual tank facility statement for capacity >1 OK gallons. Owner or operator shall file with the SJC EHD a tank facility statement that shall identify name & address of tank facility, location, size, age, & contents of each storage tank >10K gallon in capacity &that holds substance >5% of petroleum. Statement will be submitted electronically to CERS (California Environmental Reporting System) http://cers.calepa.ca.gov under ID# 10187787. Submit this document electronically within 30 days. 201, 202. The Professional Engineer (PE) certification is missing and no SPCC Plan was on site. Per HSC 25270.1.5(a), owner or operator shall prepare in writing and implement a SPCC Plan in accordance to 40 CFR 112.The PE certification must include all of the aspects in 40 CFR Part 112.3(d) (1). Immediately obtain a complete PE certification for the facility's Spill Prevention Control and Countermeasure (SPCC) plan. PE certification must include that PE or agent has visited and examined the facility, the Plan has been prepared in accordance with good engineering practice, including consideration of applicable industry standards, is familiar with the applicable requirements of 40 CFR part 112, established procedures for required inspection and testing is adequate for the facility. Submit a copy of the completed, certified SPCC plan to the EHD. This plan shall be certified by a PE in accordance with CFR 112.3(d) and the copy shall be maintained on site. 301. Failed to amend the SPCC Plan. Section 2.4 states facility has a mobile refueler on site with 750 gallon Aviation gas & 2500 gallon Jet A gas. As of the second quarter this year, mobile refueler has been removed from site. Plan must be amended when there is a change in the facility design, construction, operation, or maintenance, within 6 months of the change, and implemented as soon as possible, not later than 6 months following preparation of the amendment. Immediately make all necessary amendments to the SPCC Plan to accurately represent the procedures and policies currently in place at the facility. Submit a copy of the completed Plan with this revision. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE.
