Records of inspections were unavailable and removed to an undisclosed location per TAC <br /> operator. Section 3.1 states that inspections are performed on a monthly basis. Inspections and testing <br /> shall be conducted on all aboveground liquid petroleum containers larger than 55 gallons. Records of <br /> these inspections and tests shall be signed by the appropriate supervisor or inspector and kept on site <br /> with the SPCC Plan for a period of three years. Immediately locate a copy of all inspection and testing <br /> records for the last three years, maintain them on site, and submit copies of October and November <br /> 2013 to the EHD. <br /> 518. Annual training records were unavailable and removed to an undisclosed location per TAC <br /> operator. Section 4.0 states that TAC personnels are LSST certified. It is unclear what kind of training is <br /> provided to become LSST certified. It is unclear when or if the training was performed. At a minimum, <br /> oil-handling personnel must be trained in the operation and maintenance of equipment to prevent <br /> discharges, discharge procedure protocols, applicable pollution control laws, rules & regulations, general <br /> facility operations, and the contents of the facility's SPCC Plan. Annual briefings must be conducted to <br /> assure adequate understanding of the SPCC Plan and highlight and describe any known discharges or <br /> failures, malfunctioning components, and any recently developed precautionary measures. Immediately <br /> conduct necessary training for all oil handling personnel. Submit copies of 2013 training records and <br /> LSST certificate to the EHD. <br /> 611. Failed to test approved liquid level sensing devices. Section 9.3 states tank liquid level sensing and <br /> overfill prevention devices are checked for proper operation. SPCC Plan does not describe type of <br /> overfill prevention device on the AST nor the frequency of testing. It is unclear how the tank liquid level <br /> sensing devices are being tested, if it is tested by an certified individual and there is documentation of <br /> testing. Records of testing were unavailable and removed to an undisclosed location per TAC operator. <br /> Liquid level sensing devices must be tested regularly to ensure proper operations. <br /> Submit to SJC EHD within 30 days (12/2/13): <br /> 1. one copy of the completed "Return to Compliance Certification" form <br /> 2. a complete certified Professional Engineer SPCC Plan that address the above violations <br /> 3. a complete submittal of CERS ID# 10187787.
