The SPCC plan states that all tanks are equipped with with direct reading level gauges and high level alarms. None of the tanks were observed with both systems and only the two used oil containers were observed with level gauges. At least one of the following devices must be installed in each container: - High liquid level alarm with audible or visual signal - High liquid level pump cutoff device set to stop flow at a predetermined content level - Direct audible or code signal communication between the container gauger and the pumping station - Fast response system, such as digital computer, telepulse, or direct vision gauge. If a direct vision gauge is being used for determining the liquid level of each tank, a person must be present to monitor gauges and the overall filling of the tanks. Immediately install an approved liquid level sensing device in accordance with CFR 112.8 and implement necessary procedures to ensure that the devices are fully functional and in use at all times during tank filling operations, or provide equivalence as allowed by CFR 112.7(a)(2). This is a Class II violation. 715 CFR 112.8(c)(8)(v) Failed to regularly test liquid level sensing devices to ensure proper operation. Liquid level sensing devices have not been tested for any of the tanks regulated under APSA/SPCC requirements. Procedures and frequency of testing for these devices were not addressed in the Spill Prevention, Control, and Countermeasure (SPCC) plan. Liquid level sensing devices must be installed in accordance with CFR 112.8 and shall be regularly tested to ensure proper operation. Immediately conduct all necessary testing of liquid level sensing devices, or provide equivalence as allowed by CFR 112.7(a)(2). This is a Class II violation. 720 CFR 112.8(d)(1) Failed to provide corrosion protection for buried piping. Evidence of buried piping was observed at the facility and was corrosion protection was not addressed in the SPCC plan. Buried piping that is installed or replaced after August 16, 2002, shall be provided with a protective wrapping and coating and cathodically protected. Immediately provide all buried piping installed on or after August 16, 2002, a protective wrapping and coating and cathodic protection. This is a Class II violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork by August 15, 2018. Please be aware as of January 1, 2013, all businesses are required to submit all new (or any changes to existing) Aboveground Petroleum Storage Act (APSA) information online to the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov in addition to any other relevant activities and required fields.
