Eighth St., Stockton Program: APSA SUMMARY OF VIOLATIONS CLASS I, CLASS II,or MINOR-Notice to Comply) Notice to Comply - Minor violations: (104, 201, 303, 501, 504, 505, 507, 510, 513, 514, 517, 518, 519, 609, 611) 104. The 2012 annual permit fees for this facility have not been paid. Each year each owner or operator of a tank facility who is subject to the requirements of APSA shall pay an annual fee to the CUPA. Immediately contact the San Joaquin County Environmental Health Department (EHD) to arrange for payment of the past due amount. 201. The Professional Engineer (PE) certification is incomplete. The certification did not include statements regarding visiting the facility, consideration of applicable industry standards, procedures for inspections and testing, or the adequacy of the Plan. The PE certification must include all of the aspects in 40 CFR Part 112.3(d)(1), including attesting that the PE is familiar with 40 CFR 112, he or his agent has visited and examined the facility, the Plan has been prepared in accordance with good engineering practice, including consideration of applicable industry standards, procedures have been established for required inspections and testing, and the Plan is adequate for the facility. Immediately obtain a complete PE certification for the facility's Spill Prevention Control and Countermeasure (SPCC) plan. Submit a copy of the completed, certified SPCC plan to the EHD by September 22, 2012. 303. The SPCC Plan has a revised date of March 2009. No review log was available. You must document your completion of the review and evaluation, and must sign a statement as to whether you will amend the Plan, either at the beginning or end of the Plan, or in a log or appendix to the Plan. The following words will suffice: "I have completed the review and evaluation of the SPCC Plan for (name of facility) on (date), and will (will not) amend the Plan as a result." Immediately amend the SPCC Plan to include all necessary documentation of the Plan reviews and ensure that future Plan reviews are properly documented. 501. The SPCC Plan does not follow the order or requirements in 40 CFR Part 112. The "cross- reference" provided compared "old" versus "new" code sections, but did not include page sections. If you do not follow the sequence specified in 40 CFR 112 for the Plan, you must prepare an equivalent Plan and supplement it with a section cross-referencing the location of requirements in 40 CFR 112 and the equivalent Plan. Immediately amend the Plan to include a cross-reference or to follow the required sequence. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE. THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT EHD'S CURRENT HOURLY RATE.
