The following is an itemized list of aboveground petroleum storage act violations that <br /> have not been addressed for UNION PACIFIC RAILROAD - Stockton as of <br /> September 28, 2016. <br /> Open violations from January 12, 2016 inspection <br /> Violation #201 — Plan certification by a Professional Engineer(PE) missing or incomplete. <br /> The Professional Engineer (PE) certification is incomplete. The SPCC plan certification was dependant <br /> on completion of amendments, including replacing damaged tank gauges and installing secondary <br /> containment. The PE certification must include all of the aspects in 40 CFR 112.3(d)(1), including <br /> attesting that the PE is familiar with 40 CFR Part 112, he or his agent has visited and examined the <br /> facility, the Spill Prevention, Control, and Countermeasure (SPCC) Plan has been prepared in <br /> accordance with good engineering practice, including consideration of applicable industry standards, <br /> procedures have been established for required inspections and testing, and the Plan is adequate for the <br /> facility. Immediately obtain a complete PE certification for the facility's SPCC Plan. Submit a copy of the <br /> completed certification to the EHD. <br /> Violation #612— Failed to provide secondary containment, diversionary structures, or equipment <br /> to prevent discharge. <br /> Two mobile refueler trucks were observed parked in the northeast corner of the parking lot. The SPCC <br /> plan states, "one of the DTL trucks is parked full and unattended in the northeast corner of the parking lot <br /> southeast of the Locomotive Shop. This location does not provide adequate passive general secondary <br /> containment for the largest compartment of the truck." A facility shall provide appropriate containment <br /> and/or diversionary structures or equipment to prevent a discharge. The entire containment system, <br /> including walls and floor, must be capable of containing oil and must be constructed so that any discharge <br /> from a primary containment system will not escape the containment system before cleanup occurs. <br /> Immediately provide adequate secondary containment for all aboveground petroleum storage containers <br /> larger than 55 gallons. <br /> Open violations from August 20, 2012 inspection <br /> Violation #514— Failed to provide secondary containment and/or diversionary structures that are <br /> capable of containing discharge from primary containment until it is cleaned up. <br /> The two 6,000 gallon fueling trucks are parked in the main parking lot for the facility and do not have <br /> secondary containment. A facility shall provide appropriate containment and/or diversionary structures or <br /> equipment to prevent a discharge. The entire containment system, including walls and floor, must be <br /> capable of containing oil and must be constructed so that any discharge from a primary containment <br /> system will not escape the containment system before cleanup occurs. Immediately provide adequate <br /> secondary containment for all aboveground petroleum storage containers larger than 55 gallons. <br /> Page 5 of 5 <br />
