Newton Rd, Stockton Program: APSA SUMMARY OF VIOLATIONS (CLASS I, CLASS 11, or MINOR-Notice to Comply) Routine Aboveground Petroleum Storage Act Inspection # 1. Failed to prepare a written SPCC Plan in accordance with Code of Federal Regulations Part 112. No such SPCC Plan was written. Each owner/operator of a storage tank shall prepare a spill prevention control and countermeasure plan. They shall also conduct periodic inspection of this storage tank to assure compliance. An aboveground tank means any tank that has the capacity to store 55 gallons or more of any type or percentage of petroleum mixture and that is store substantially above the ground surface shall be included in the SPCC Plan. Correct by having a professional engineer certify the tank facility's SPCC Plan. Submit a copy of the page that has the professional engineer's signature certifying the plan. # 7. Failed to retain a copy of the SPCC Plan on-site. The owner/operator of the tank facility shall have the plan retained on-site readily review by an inspector upon request. Correct by keeping a copy of the SPCC Plan on-site. Notes-. • Aboveground Storage Tank (AST) is three compartments and is double-wall. Unleaded gasoline and clear diesel is no longer in use since beginning of this year since it is not economically feasible. • Facility used to perform regular testing with San Joaquin Valley Unified Air Pollution and Alltech testing technicians. Since the only product held in tank is red diesel <_ 500 gallons on-site, testing such as pressure decay is no longer performed. • If this AST is completely "empty" AST container meeting the federal SPCC rule definition of "permanently closed", it will not be regulated under APSA. "Permanently close" is defined in 40 CFR 112.2 • In a `Return to Compliance Certification' statement written by Service Mgr. R. Greg Peet, for a hazardous waste inspection report dated 06/06/2005, Peet stated no corrective action was taken at that time to correct the failure for not having a SPCC plan. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE($115). THIS FACILITY IS SUBJECT TO REINSPECTION- EHD'S CURRENT HOURLY RATE.
