Apr 23 03 09:17a <br />SmeOhCO <br />925-631-6707 <br />p.3 <br />• <br />I" AMENDMENT TO ENTRY AGREEMENT <br />This 1" AMENDMENT TO ENTRY AGREEMENT amends the Entry Agreement effective June <br />1", 1999 by and between Pacific Gas and Electric Company (PG&E) and Gerrit Hofman <br />(hereafter referred to as "OwneeD, regarding Owner's property adjacent to PG&E's McMullin <br />Dehydrator Station (hereafter referred to as the "Station"), situated on the east side of Airport <br />Way south of the intersection of Perrin Road in San Joaquin County. <br />PG&E and Owner agree as follows: <br />1) It is further understood between Owner and PG&E that; <br />A. PG&E has conducted extensive environmental investigations to determine the <br />horizontal and vertical extent of petroleum hydrocarbons in the soil and groundwater <br />at its Station and Owner's Property, resulting from Station operations; <br />B. PG&E desires to perform environmental remediation activities on Owner's <br />Property and the Station to reduce the concentrations of petroleum hydrocarbons in <br />the soil and the groundwater; <br />C. Owner desires to have PG&E enter his property to perform environmental <br />remediation activities in accordance with plans approved by the Central Valley <br />Regional Water Quality Control Board; and, <br />D. Environmental clean-up activities are invasive, require heavy equipment to <br />remove soil and/or groundwater; and may take several days, or longer, to complete. <br />2) Owner grants permission to PG&E, including its employees, contractors, subcontractors <br />and agents, to enter Owner's Property between October 16`s and November 17'" 2002, to <br />conduct remedial activities necessary to remove as reasonable, petroleum hydrocarbons <br />in the soil and/or the groundwater related to PG&E's operations at the Station. Activities <br />will include excavation of approximately 1000 cubic yards of soil to an estimated depth <br />of 14 feet [as depicted in Exhibit A (Drawing C-3)] and dewatering of the excavation <br />area. PG&E's activities will occur between 6:00 AM and 6:00 PM, seven days per week <br />PG&E will temporarily fence around the area where remedial activities will occur to <br />deter unauthorized access to the remediation area, and may store and stage necessary <br />equipment, vehicles and other materials overnight and over weekends in the fenced area. <br />The approximate arca to be temporarily fenced is outlined in Exhibit A., and extends <br />approximately 55 to 65 feet east of the Station. <br />3) PG&E's activities will be in accordance with plans approved by the Central Valley <br />Regional Water Quality Control Board. Copies of the approved plans shall be given to <br />Owner prior to activities beginning on Owner's property. The amount of soil excavated <br />will be determined by safety considerations and by the Central Valley Regional Water <br />Control Board in accordance with its policies and regulations. <br />4) PG&E shall use its best efforts to communicate with Owner about its schedule for <br />remedial activities. While PG&E's remedial activities are ongoing, PG&E shall use <br />reasonable efforts to minimize interference with Owner's activities in the vicinity of the <br />site. The dirt road north of the Station and east of Airport Way shall remain accessible to <br />Owner's vehicles during remedial activities. <br />5) Prior to October 16'h, 2002, Owner shall prepare Owner's Property by relocating <br />livestock, livestock fencing, a livestock chute, and other equipment and facilities in the <br />area to be temporarily fenced as outlined in Exhibit A, with the exception of a concrete <br />
