Apr 23 03 09:17a Sme hCO 925-631-6707 p.4 <br />• <br />1st Amendment to Entry Agreement <br />Gerit Hofman <br />PG&E McMullin Dehydrator Station <br />Page 2 of 3 <br />pad adjacent to the northeast comer of the Station, and any other concrete facilities. <br />PG&E shall remove all, or a portion of the concrete pad, and any other concrete facilities, <br />as necessary, during its remedial activities. <br />6) PG&E shall backfill the excavation with base rock at and below the groundwater table <br />and CalTrans Class II road base fill (engineered fill) above the groundwater table to the <br />surface. Backfilled areas will be returned as near as possible to their pre-existing grade. <br />As agreed between Owner and PG&E, Owner shall be responsible for replacing all of <br />Owner's surface facilities that are removed and or relocated as a result of PG&E's <br />remedial activities, including concrete facilities. PG&E will compensate Owner <br />$16,000.00 (sixteen thousand dollars) for inconvenience, and for the removal and <br />replacement of all of Owner's affected facilities and equipment. In addition, in the event <br />that Owner must remove and replace more than 60' (sixty feet) of livestock fencing as a <br />result of the PG&E's remedial activities, PG&E shall compensate Owner $50.00 (fifty <br />dollars) for each linear foot of fencing over sixty feet. And further, in the event that <br />remedial activities cause soil to be excavated on Owner's Property at a distance greater <br />than sixty feet east of the station, and in the event that this excavation at a distance <br />greater than sixty feet cast of the Station requires that Owner replace cement, then, and <br />only then, Owner will be compensated $2.50 (two dollars and fifty cents) per square foot <br />for every square foot of concrete replaced at a distance greater than sixty feet from the <br />Station. <br />7) Excavated soil from Owner's Property will be removed and disposed -of by PG&E in <br />accordance with all federal, state and local regulations. <br />$) PG&E shall notify Owner when site remedial activities are complete and shall submit to <br />Owner a report on the remedial activities conducted. <br />9) In addition to the amounts set forth above in paragraph 6, Owner shall be compensated <br />$300.00 (three hundred dollars) per day for each day or part of a day PG&E or its <br />contractors remain on Owner's Property after November 60h. Provided however, that no <br />additional daily compensation will be paid Owner in the event PG&E has completed its <br />remedial activities, and removed its materials and equipment on Owner's Property, <br />within 21 (twenty-one) days of October 16'h, or within 21 days of Owner's completion of <br />its obligations under Paragraph 5, should that occur later than October I50i. <br />10) PG&E shall remove all of its vehicles, equipment, temporary fencing and excess <br />materials promptly when site remedial activities are complete. <br />11) All other terms of the Entry Agreement shall remain in full force and effect. <br />Owner's Signature <br />Pacific Gas and Electric Company <br />d� <br />BY: Q <br />Hofman Manager, Land Services <br />Date: October/02002 Date: October ?l2002 <br />Approved as to form <br />A N.JAYO <br />PG&E Law Dept. <br />
