Apr 23 03 09:17a Sme6co 92 0 1-6707 p.5 <br />ENTRY AGREEMENT <br />This Entry Agreement is made and entered into effective June 1, 1999, by and between Pacific Gas and <br />Electric Company (PG&E-) and <br />Ed Cardoza <br />(hereafter referred to as "Owner") with regard to Owner's property located <br />near PG&E's McMullin Dehydrator Station close to the intersection of Airport Way and Perrin Road in <br />San Joaquin County <br />(hereafter referred to as "Owner's Property") <br />It is understood between PG&E and Owner that: <br />A. PG&E has installed one groundwater monitoring well on Owner's Property to monitor groundwater <br />which may be affected by PG&E's operations at its nearby natural gas facility, <br />B. PG&E requires access to the installed groundwater monitoring well on a periodic basis, and <br />C. Owner wishes to provide PG&E with access to Owner's Property to periodically take groundwater <br />samples from and to maintain the installed well. Therefore, <br />Owner and PG&E agree as follows: <br />1. A temporary License is hereby given to PG&E and its contractors and subcontractors, to enter <br />Owner's Property four times per year, to collect groundwater samples from the groundwater <br />monitoring well previously installed by PG&E-, and to perform any necessary well maintenance <br />activities. <br />2. PG&E shall notify Owner at least 48 hours in advance of its entry upon Owner's Property to collect <br />groundwater samples and perform any necessary well maintenance activities. <br />3. After each entry, PG&E shall leave Owner's Property in substantially the same condition in which it <br />was found. <br />4. PG&E shall close the monitoring well in accordance with all local, State and Federal regulations, <br />when the Central Valley Regional Water Quality Control Board no longer requires groundwater <br />samples to be taken. PG&E shall return Owner's Property, as near as practicable, to its original <br />condition. <br />5. PG&E's activities on Owner's Property shall comply with all applicable safety, health, and <br />environmental rules and regulations. '{ <br />6. Reports of analyses of groundwater samples taken from Owner's Property shall be submitted to <br />Owner on an ongoing basis. <br />i. PG&E shall indemnify Property Owner for any property damage caused by PC&E's sampling and <br />well maintenance activities. <br />8.
