1 IT IS HEREBY ORDERED that J. Benjamin McGrew ("the <br />2 Receiver") be appointed Receiver of the real property commonly <br />3 known as 530, 560 and 574 W. Grantline Road, Tracy, California <br />4 (hereinafter "the Property") upon his filing of a bond in the <br />5 amount of $10,000 to secure the faithful performance of his duties <br />6 as the Receiver in this action. <br />7 IT IS FURTHER ORDERED that the Receiver shall have the <br />8 following powers and responsibilities: <br />9 1. To enter, gain access to and take possession of the <br />10 Property and each and every past thereof; to exclude defendants, <br />11 or anyone claiming under or through them, therefrom who are not <br />12 under valid leases or rental agreements to use, operate, manage <br />13 and control said Property; to receive the rents, lease payments <br />14 and profits therefrom; to care for, preserve and maintain the <br />15 Property, including remediation work mandated by governmental <br />16 agencies; to incur the expenses necessary for such care, <br />17 preservation, maintenance and remediation work; and to do all the <br />18 things and to incur the risks and obligations ordinarily incurred <br />19 by owners, managers and operators of similar businesses and <br />20 enterprises, as such Receiver, and no risk or obligation so issued <br />21 shall be the personal risk or obligation of the Receiver, but <br />22 shall be a risk or obligation to the receivership estate; <br />23 2.
