Tracy Program: UST SUMMARY OF VIOLATIONS (CLASS I, CLASS II, or MINOR -Notice to Comply) UST Inspection: Routine and Annual Monitoring System Certification 4. Financial responsibility documents have not been submitted to the EHD in a timely manner. Previous financial responsibility was submitted 10/08/2009. Current financial responsibility submitted 12/09/2010, two months late. Current financial responsibility documents are required to be submitted annually in a timely manner. Ensure future financial responsibility documents: Certification of Financial Responsibility and Letter from Chief Financial Officers are submitted in a timely manner. 2. Secondary containment testing was last performed on 08/10/2007 and was due by August 2010. Testing has not been completed and is four months past due. Partial secondary containment testing was done on 12/06/2010 under SR0060720: UDC 1-8, STP 87 & 91, piping 87 & 91- all passed. Tank annular 87 & 91 not performed yet. Secondary containment testing is required once every 36 months. Immediately schedule this test and provide 48 hours notification to the EHD. Take all necessary precautions to ensure testing is performed in a timely manner. Test results must be submitted to EHD within 30 days of testing. - Per owner, tank annulars will be tested today. 24, 25, & 26. Annual monitoring system certification, leak detector testing, and spill container testing were last performed on 10/08/2009 and was completed today on 12/17/2010, two months past due. These tests are required once every 12 months. Take all necessary precautions to ensure testing is performed in a timely manner. 31. The UST system at this facility has been identified by the State Water Resources Control Board to be located within 1000 feet of a public drinking water well and must test the UST system once using an enhanced leak detection test. A ELD testing notice dated 03/01/2010 was sent to the facility. This testing has not been completed. A Request for Reconsideration (RFR) Form dated 08/31/10 was submitted to SWRCB but no response has been received. Immediately contact SWRCB if request was granted or schedule this test and provide 48 hours notification to the EHD. Provide copies if request was granted or submit the test results within 30 days of testing. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE ($122).
