STOCKTON <br />November 25 2015 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS 11, or MINOR - Notice to Comply) <br />Item # <br />Remarks <br />301 <br />CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br />Used absorbent was observed on the ground around the used oil drums outside and in a pile on the floor of the shop <br />just inside the door leading to the yard. According to Mr. Huynit, the absorbent is wet from the recent rains, but will <br />dry out when it is sunny and will be reused. No containment was observed for preventing the oil absorbed from being <br />rinsed out to the ground. Facilities shall be maintained and operated to minimize the possibility of a fire, explosion, or <br />release of hazardous waste to air, soil, or surface water which could threaten human health or the environment. <br />Immediately contain all used absorbent in a manner which prevents oil from leaking to the environment, and manage <br />according to Title 22 hazardous waste regulations. Submit a statement and supporting documentation explaining how <br />this waste was managed. <br />This is a minor violation. <br />303 <br />CCR 66262.34(4)(2) Failed to maintain all communication or alarm systems, spill control, or decontamination <br />equipment. <br />The fire extinguisher on site was observed with a gauge reading "recharge" and no annual maintenance date marked. <br />Liquid was observed in the secondary containment under a used oil drum behind the facility. All facility <br />communications or alarm systems, fire protection equipment, spill control equipment, and decontamination <br />equipment, where required, shall be tested and maintained as necessary to assure its proper operation in time of <br />emergency. Immediately begin this practice. <br />This is a minor violation. <br />403 <br />CCR 66262.34(d)(2) Failed to keep hazardous waste containers closed except when adding or removing hazardous <br />waste. <br />Three 55 gallon drums of used oil were observed in the storage area behind the facility with open bungholes. All <br />hazardous waste containers shall be closed at all times except when adding or removing waste. Immediately close <br />these containers and ensure all hazardous waste containers are closed when not adding or removing waste. <br />This is a minor violation. <br />406 <br />CCR 66261.7(f) Contaminated container not marked with date emptied or managed within one year of being emptied. <br />A 55 gallon blue steel drum which previously held oil was observed behind the facility with no empty labeling. <br />Containers larger than five gallons that previously held a hazardous material shall be marked with the date they were <br />emptied and managed within one year of being emptied.
