Used fluorescent bulbs were observed in buckets, drums and uncontainerized, unlabeled in the <br />storage container by the auto crusher. A generator shall label or mark universal waste with the words <br />'Universal Waste' and the type of waste (batteries, mercury containing equipment, lamps/bulbs, <br />electronic devices, CRTs, CRT glass, aerosol cans). Immediately label these wastes and ensure that all <br />universal wastes are labeled with the required infonnaiion. <br />REPEAT VIOLATION <br />Notice to Comply - Minor violations: (7, 18, 22, 32, 45, 49, 59, 60, 61, 62, 85) <br />7. Metal fines generated from metal grinding, cutting, and drilling are 'being disposed of without first <br />determining particle size or hazardous properties. Spillage was observed in the secondary containment <br />for the diesel tank; no hazardous waste determination has been made. PCB ballasts were observed <br />incorrectly labeled as universal waste. Any person who generates a waste shall determine if the waste <br />is a hazardous waste. Immediately stop disposal of metal fines and remove all waste from secondary <br />containment, make a hazardous waste determination for these wastes, and manage them according to <br />Title 22 hazardous waste regulations. Metal particles 100 microns or smaller must be handled as <br />hazardous waste if the metal is determined to be a hazardous waste. Submit a statement and <br />supporting documentation explaining how these wastes were managed by September 23, 2011. The <br />PCB ballasts were labeled as hazardous waste at the time of inspection. <br />18. Two 5 gallon buckets of contaminated soil were observed in the wash area without labels. Two 55 <br />gallon black steel drums of used absorbent were observed with accumulation start dates of April 29, <br />2011 and May 17, 2011. A black steel drum of PCB ballasts was observed in the appliance recycling <br />area with an accumulation start date of April 12, 2011. A red steel drum of used oil was observed in the <br />appliance recycling area with an accumulation start date of January 11, 2011. Facilities who generate <br />1000 kg or more of hazardous waste per month and or exceed 6000 kg of waste stored on site at any <br />time may not store waste on site for longer than 90 days. Immediately contact a licensed hazardous <br />waste hauler to dispose of these wastes under manifest and submit a copy of the manifest to the EHD <br />by September 23, 2011. <br />22. A damaged lead acid battery was observed uncontainerized in the shop next to the office. A 55 <br />gallon black poly drum of damaged lead acid batteries was observed without a date labeled in the shop <br />next to the office. A damaged battery shall be managed so as to minimize the release of acid and lead <br />and to protect the handlers and the environment, including at a minimum: <br />ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE.
