Immediate Reporting of a Release or a Threatened Release <br /> Guidelines <br /> If in doubt,please call San Joaquin County Office of Emergency Services(OES)Hazardous Materials <br /> Divison (209) 468-3969. OES is the Administering Agency. Our staff will assist you in determining <br /> the status of the release. <br /> A. A person shall provide an immediate,verbal report of any release or threatened release of a <br /> hazardous material to the Administering Agency (209) 468-3969 and to the State Warning Center <br /> (800) 852-7550 as soon as: <br /> (1) a person has knowledge of the release or threatened release; <br /> (2) notification can be provided without impeding immediate control of the release or <br /> threatened release; and <br /> (3) notification can be provided without impeding immediate emergency medical measures. <br /> B. The immediate reporting pursuant to subsection (a)of this section shall include,at a minimum: <br /> (1) the exact location of the release or threatened release; <br /> (2) the name of the person reporting the release or threatened release; <br /> (3) the hazardous materials involved in the release or threatened release; <br /> (4) an estimate of the quantity of hazardous materials involved; and <br /> (5) if known, the potential hazards presented by the hazardous material involved in the release <br /> or threatened release. <br /> C. The immediate reporting pursuant to subsection(a)of this section shall not be required if there is <br /> a reasonable belief that the release or threatened release poses no significant present or potential <br /> hazard to human health and safety, property,or the environment. <br /> The following criteria to use for determining if notifications need to be made by your business are <br /> recommended by the San Joaquin County Office of Emergency Services: <br /> (1) Quantity of released or potentially released material. <br /> (2) Offsite consequences. <br /> (3) Employee safety. <br /> (4) Public safety. <br /> (5) Environmental concerns. <br /> (6) Material type and conditions of release (i.e., flammable liquid released into storm drain). <br /> Acutely Hazardous Materials(AHM)which are released at the Reportable Quantity(RQ)or greater <br /> must be reported to OES regardless of the circumstances surrounding the incident. <br /> Businesses which fail to make proper notifications may be liable for up to$25,000 for each day of the <br /> violation, or by imprisonment in the county jail for not more than one year, or by both the fine and <br /> imprisonment. <br /> n <br />
