DESCRIPTION OF LEGAL REQUIREMENTS FOR BUSINESSES <br /> (Retain for future reference) <br /> AB 2185(WATERS)was signed by GovernorDeukmejian in September 1985 and was incorporated into <br /> the State Law as Chapter 6.95,Division 20,Section 25500 et seq. of the State Health and Safety Code. <br /> It requires each county to designate an agency to administer and implement the law. In San Joaquin <br /> County,the Administering Agency is the Office of Emergency Services (OES). <br /> The law applies to businesses that handle a hazardous material, or a mixture containing a hazardous <br /> material, in a quantity equal to or greater than 55 gallons, 500 pounds, or 200 cubic feet at standard <br /> pressure and temperature at any one time in the year. These quantities may be of a mixture of which only <br /> a portion is a hazardous material. If your business handles an acutely hazardous materials,then use the <br /> Threshold Planning Quantity associated with the chemical for inventory reporting purposes. Please <br /> complete an Acutely Hazardous Materials (AHM)Registration Form(FORM HM 3777)and submit <br /> to OES. <br /> "Hazardous material"means any material that,because of its quantity,concentration,or physical <br /> or chemical characteristics,poses a significant present or potential hazard to human health and <br /> safety or to the environment if released into the workplace or the environment. Examples include: <br /> Fuels,petroleum products,paints,propane,oxygen,ammonia(AHM),chlorine(AHM),pesticides,fer- <br /> tilizers,and hazardous wastes.. . . The Office of Emergency Services can assist with this determination. <br /> For those businesses which come under this law there are several requirements which must be <br /> met: <br /> Businesses must prepare a Hazardous Materials Management Plan to be submitted to the <br /> County Office of Emergency Services and to be used by the business. Updates must be <br /> submitted to the County Office of Emergency Services within 30 days of any changes. <br /> An annual inventory form must be submitted to the County Office of Emergency Services. <br /> Businesses must immediately report releases, or threatened releases of hazardous <br /> materials, to local emergency response agencies and to the County Office of Emergency <br /> Services when they pose a significant present or potential hazard to human health or to <br /> the environment. (See pages 11 & 111). <br /> Businesses must report unauthorized releases of hazardous materials to the County Office <br /> of Emergency Services (209)468-3969 and to the State Warning Center(800) 852-7550. <br /> Businesses must implement their plans in case of an emergency. <br /> I <br />
