This facility does not have a valid ID number to manage hazardous waste. A hazardous waste generator shall not treat, store, dispose of, transport or offer for transportation, hazardous waste without an ID number. If you or your business generates more than 100 kg of RCRA hazardous waste and/or more than one kg of acutely hazardous waste, then you need to obtain an EPA ID number. All others must obtain a State ID number. Go to the DTSC web site http://www.dtsc.ca.gov/IDManifesVPERMHWID.cfm for the form to apply for an ID number. Immediately obtain an ID number to manage hazardous waste and submit evidence to the EHD. This is a minor violation. 104 CCR 66262.34(d)(2) No modified contingency plan. An emergency coordinator and modified contingency plan information is lacking. There must be at least one emergency coordinator on site or on call to coordinate emergency response measures, and the following information must be posted by a phone: the name and phone number of the emergency coordinator; location of fire extinguishers, spill control equipment, and if present, fire alarm; and the phone number of the fire department, unless the facility has a direct alarm. Immediately appoint an emergency coordinator and post the required information by a phone. A form is provided that can be used for this purpose. This is a minor violation. 106 CCR 66262.34(d)(2) Failed to train employees on waste handling and emergency procedures. At the time of inspection, it could not be demonstrated (not necessarily documented)that employees who handle hazardous waste were properly trained. Antonio Del Toro was asked how to handle, recognize, and label hazardous waste during time of inspection and he could not provide some basic hazardous waste training. However, he was able to explain how to clean up a spill. The generator must ensure that all employees who handle hazardous waste are thoroughly familiar with proper waste handling and emergency procedures. Provide proof of training to the EHD for employees whose responsibilities include hazardous waste. This is a minor violation. 119 HSC 25404(e)(4) Failed to report program data electronically. Please be aware as of January 1, 2013, all businesses are required to submit all hazardous materials information online to the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov. Be sure to include your hazardous waste activity in the Businesses Activities section in CERS in addition to any other relevant activities and required fields. This is a Class II violation. 302 CCR 66262.34(d)(2) Failed to maintain required emergency equipment. Fire extinguishers were found on site but they are expired and spill control kit was not available. All facilities shall be equipped with an internal communication or alarm system, a device capable of calling outside emergency help, spill control equipment, and decontamination equipment at all times. Immediately provide up to date fire extinguishers and spill containment kit and maintain on site. This is a minor violation.
