An inspection was last done on March 27, 2012 and an inspection report was issued identifying information to be submitted to bring this site into compliance. This information was required to be submitted by April 27, 2012. This information has not been received resulting in a non-compliant status for this facility. An operator that receives an inspection report shall have 30 days to submit a written response that includes a statement documenting corrective actions taken or proposing corrective actions which will be taken. Ensure that a written response documenting corrective actions taken or proposed is submitted within 30 days of receiving an inspection report. The following violations are outstanding violations from March 27, 2012: 101: Managed a hazardous waste without a EPA number 122: Failed to keep signed copy of manifest for 3 years 125: Failed to keep a copy of consolidated manifest for 3 years 127: Failed to retain copy of manifest or bill of lading for spent lead acid batteries for 3 years 128: Failed to retain copy of bill of lading for used oil filters for 3 years 301: Facility not maintained to minimize the release of a hazardous waste 404: Failed to keep containers of HW closed except when adding or removing HW 605: Failed to complete label containers or tanks of hazardous waste 610: Failed to store used oil filters in a closed, rainproof container that is labeled "drained used oil filters"and marked with the accumulation start date 812: Failed to keep records of each shipment of universal waste This is a Class II violation. 117 HSC 25404(e)(4) Failed to report program data electronically. A submission to the California Electronic Reporting System (CERS)for the hazardous waste program has not been made. Beginning January 1, 2013, all businesses are required to submit all new(or any changes to existing) hazardous waste information online to the CERS at http://cers.calepa.ca.gov. Be sure to include your hazardous waste activity in the Businesses Activities section in CERS in addition to any other relevant activities and required fields. This is a Class II violation. 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. Dark stains observed near the used oil tank, secondary containment of waste antifreeze and the engine part sitting on top of a pallet. Asked the general manager, Bao Nguyen, about the cause of spill near the used oil tank and he stated that it was from the oil pickup and not from a leak. Facilities shall be maintained and operated to minimize the possibility of a fire, explosion, or release of hazardous waste to air, soil, or surface water which could threaten human health or the environment. Immediately clean the spill, and manage according to Title 22 hazardous waste regulations. Submit a statement and supporting documentation explaining how this waste was managed.
