Pursuant to Section 66264.193(g); While this connecting piping is partly exposed to weather and partially inside a covered shed and will not contain any leak as it occurs; 7. The requirement for further containment based on the single-wall construction details has been partially addressed with the placement of spill containment pallets under the pump and pipe connections inside the transfer shed. The industrial hose outside the transfer shed has not been addressed regarding spill containment such as using double-wall construction (i.e. outer wall containment piping around the primary piping that is in contact with the non-RCRA waste stream; or installing a secondary containment system, such as a liner underneath, or coating on, the concrete under the piping to prevent permeation of used oil into the concrete over time. There is no waste treatment processing in the containment area. No further concern is attached to this storage arrangement under the conditions seen at the site and as described further herein. The connecting piping does not currently meet the requirements for secondary containment under DTSC regulations. We believe that the above information provides a suitable assessment of the Used Oil Storage Tank Containment Area for Pape Machinery, Inc. at their facility in French Camp, CA, for structures containing used oil, a non-RCRA hazardous waste material, and that this containment area does meet the requirements for secondary containment for such materials as required by CA DTSC Title 22 CCR §66264.193 except for the Transfer Shed area.
