03/26/02 Meeting took place this date. Attorney for the Segarini Trust requested time to submit an application to the SWRCB CUF and to hire a surveyor in an attempt to determine if part of the UST system was actually located on an adjacent parcel of land. 04/11/02 "NOR" and site letter sent this date to Theresa Marler at a new address. 04/11/02 SJC/EHD correspondence sent to Theresa Marler at a new address requesting her cooperation as the party eligible to the SWRCB CUF in getting this site qualified. Ms. Marler never responded to the letter. 05/13/02 "NOR" and site letter sent to Theresa Marler returned this date marked 'unclaimed'. 06/26/02 SWRCB CUF letter; site found to be ineligible for placement on the Priority List. 07/03/02 Correspondence from Attorney for the Segarini Trust; surveyors map was included which shows the property to be 55 feet wide measured from the eastern property line. A site map drawn at the time of the tank removal was included; the map shows the western extent of the tank pit area to be 49 feet from the eastern property boundary, and the western dispenser island area to be 52 feet from the eastern property line. Both of these areas appear to be fully located on the Segarini property. 11/06/02 Correspondence from Attorney for the Segarini Trust to SWRCB requesting review of the decision finding the Trust ineligible for the fund. 11/26/02 SWRCB CUF correspondence stating Final Division Decision to concur with Fund Manger Decision to deny eligibility of the Trust to the CUF. 12/23/02 Date of Petition for appeal of SWRCB CUF decision to deny eligibility of the Segarini Trust to the CUF. 01/08/03 Most recent date of SWRCB CUF correspondence received by SJC/EHD concerning this site; acknowledging receipt of petition submitted on behalf of the Segarini Trust. 05/03/05 SJC/EHD determination that since Segarini Trust has not complied with directives for further site investigation one more directive would be provided. If compliance were still not achieved, referral to the RWQCB would be made. 07/28/05 SJC/EHD correspondence sent this date to Segarini Trust directing the submittal of a work plan no later than September 23, 2005. 10/04/05 No work plan has been submitted for continuation of the site investigation; therefore the site is being referred to the RWQCB.
