Alpine <br /> Stockton CA 95204 <br /> As the responsible party to the above referenced contaminated underground storage tank (UST) <br /> site you were directed by San Joaquin County Environmental Health Department (SJC/EHD) in <br /> correspondence dated March 5, 2002 to submit a work plan to define the vertical and lateral extent <br /> of the documented petroleum hydrocarbon contamination at the site. The work plan was due for <br /> submittal by October 27, 2000, but was never received by this agency. You were further notified in <br /> the March 5, 2002 letter that a meeting was scheduled to discuss your failure to submit the <br /> requested work plan. <br /> The meeting was held on March 26, 2002. At the meeting your attorney requested time to submit <br /> an application on your behalf to the State Water Resources Control Board Cleanup Fund (CUF), <br /> and to have your site surveyed in an attempt to determine if a portion of the UST system may have <br /> been located on an adjacent property. Your attorney suggested that SJC/EHD name the owner of <br /> the adjacent property as an additional responsible party. <br /> It is the understanding of SJC/EHD that your application for eligibility to the CUF has been <br /> appealed, but that your appeals have been denied. The last correspondence SJC/EHD received <br /> on this matter from the CUF counsel was dated January 8, 2003. Please notify SJC/EHD if this <br /> situation has changed. <br /> The survey map was submitted to SJC/EHD July 3, 2002. The map shows the property owned by <br /> the Segarini Trust to be 55 feet wide measured from the sidewalk fronting EI Dorado Street. Also <br /> submitted was a map from the SJC/EHD UST file, prepared by the SJC/EHD inspector on site at <br /> the time the UST's were removed. This map shows the tank pit area to be approximately 49 feet, <br /> and the dispenser island area located on the southwestern portion of the station to be <br /> approximately 52 feet, from the sidewalk fronting EI Dorado Street. SJC/EHD finds no support in <br /> these documents to name an additional responsible party to this site. <br /> Please proceed with submittal of the requested work plan. The work plan is due for submittal no <br /> later than September 23, 2005. If a work plan is not submitted by this date the site will be referred <br /> to the Regional Water Quality Control Board-Central Valley Region for enforcement action.
