f • • <br /> A description of why the responsible party for the unauthorized release cannot or will not <br /> cleanup the contamination or abate its effects; <br /> The RP has failed to respond to any and all attempts by regulatory agencies to initiate cleanup. See <br /> attached correspondence as described above including return to sender and unclaimed stamps on <br /> certified mail correspondence. In addition this property is in tax default according to San Joaquin <br /> County Tax Assessors Office. <br /> Documentation of any disputes between the regulatory agency and the responsible party; <br /> None <br /> Any actions which have been previously taken to cleanup or abate the effects of the <br /> unauthorized release; <br /> None <br /> A description of how the proposed cleanup and abatement is to be accomplished; <br /> PHS/EHD has entered into a verbal agreement on 11-3-95 with C &R Fence of Stockton, CA to <br /> maintain the fence until the excavation can be backfilled and compacted. <br /> Debris and vegetation in the existing excavation shall be removed by a licensed contractor prior to <br /> backfilling with clean low permeability imported fill and compacted to City of Stockton (COS) <br /> Building Department and Uniform Building Code requirements. Prior to backfilling subsurface soil <br /> samples shall be obtained to assess the contaminant distribution both laterally and vertically in the <br /> excavation. Samples shall be analyzed for TPH(g),BTEX and lead in a State Certified laboratory. <br /> Finished grade shall slope away from the excavation area and site to prevent ponding. All <br /> excavation,backfill, and grading shall be performed under COS permit. Profiled soil stockpiles shall <br /> be offhauled under appropriate manifest to a landfill certified to receive contaminated soil. All <br /> contractual obligations and agreements shall be appropriately documented and payments made in <br /> accordance UST EAR account policies. <br /> Further site assessment, characterization and remediation may be proposed as needed. <br /> An annual cost estimate and a total cost estimate for the proposed cleanup and abatement <br /> including staff costs; <br /> See attached bid proposal and approval signature for soil offhaul, excavation backfill and <br /> compaction: _ $24,962.10 <br /> Temporary Panel Fencing: 18 Panels for 1 month = $ 108.00 <br /> See attached Invoice from C &R Fence Contractors <br />
