10/16/95 15:34 UST CLEANUP FUND 4 912094640138 NO. 112 UO3 <br /> 5/24/94 • • UST EAR Account <br /> Re Tonal Water Board: Upon request by the State Water Board, notifies their <br /> LIAs to nom nate high priority sites for inclusion on the regional annual list <br /> of abandoned and recalcitrant sites for EAR Account funding. <br /> Prioritizes and submits their annual list of abandoned and recalcitrant LIA <br /> and Regional Water Board sites to the State Water Board for statewide <br /> prioritization and funding consideration. <br /> State Water Board: Approve, modify, or disapprove the annual abandoned and <br /> recalcitrant site priority list including recommended funding levels, based on <br /> availability of funds. Additionally, will approve, modify or disapprove all <br /> prompt action funding requests. <br /> FORMS <br /> o APPROVAL FOR EMERGENCY FUNDING FORM (Apgndix A - This form is completed <br /> and signed by the Division ief, DCWP or out orized representative) and <br /> forwarded to the Regional Water Board Executive Officer, or the LIA <br /> Director, and the State Water Board's Accounting Office, upon approval of <br /> a verbal request for emergency funding. <br /> o REQUEST FOR FUNDS FORM (Appendix B) - This form is completed by the <br /> Regional ter Board Executive 0 icer or the LIA Director (or their <br /> designee) and is submitted to the UST Cleanup Fund Section Chief, DCWP, <br /> at the time of prompt action or abandoned, recalcitrant site funding <br /> requests. <br /> c REQUEST FOR PAYMENT FORM (Appendix C) - This form is submitted to the UST <br /> Cleanup Fund Section Chief with the appropriate invoices, at the time of <br /> payment requests. The DCWP will forward the request to the DAS <br /> Accounting Office to process payments. <br /> USE OF THE EAR ACCOUNT <br /> The EAR Account is to he used primarily to: <br /> o Provide funding to Regional Water Boards and LIAs to initiate emergency <br /> corrective action at petroleum UST sites where immediate action is <br /> required to protect human health, safety and the environment and any <br /> delay, while awaiting State Water Board approval of the request, would <br /> endanger human health, safety or the environment (emergency sites); <br /> o Provide funding to Regional Water Boards and LIAs to initiate prompt <br /> corrective action at petroleum UST sites where such prompt action is <br /> required to protect human health, safety and the environment, and the <br /> responsible party, if any, has failed to comply with a corrective action <br /> order (prompt action sites). A corrective action order may include any <br /> written order issued by a Regional Water Board or, a written order issued <br /> by the LIA which designates that the order was issued in accordance with <br /> Section 25299.37(c) of Chapter 6.75, and which: (1) specifies the <br /> required corrective action directives; (2) includes a time schedule for <br /> completion of specific directives; and, (3) informs the responsible party <br /> of the enforcement actions and liabilities that may be imposed if the <br /> responsible party fails to comply.
