10/16/95 15:35 UST CLEANUP FUND -+ 912094640138 N0. 112 PO4 <br /> 5124/94 UST EAR Account <br /> limited to those sites where the required prompt corrective action cannot <br /> wait until the next annual EAR Account priority list is developed in <br /> accordance with the Annual Schedule for Processing Abandoned and <br /> Recalcitrant Site Funding Request section of this APM (page 7); <br /> o Pro!,ide funding to Regional Water Boards and LIAS to initiate corrective <br /> action at petroleum UST sites where no responsible party has been <br /> identified or located (abandoned sites); <br /> o Provide funding to Regional Water Boards and LIAs to initiate corrective <br /> action at petroleum UST sites where the responsible party is-either <br /> unable or unwilling to take the required corrective action in response to <br /> a Regional Water Board or a LIA corrective action order, issued pursuant <br /> to Section 25299.37(c) of Chapter 6.75 (recalcitrant sites); <br /> o Pay for LIA oversight costs directly associated with the required <br /> corrective action; and <br /> o Pay appropriate costs associated with administration of the EAR Account <br /> and recovery of costs from the responsible party. <br /> o The followirg may utilize the EAR Account: <br /> - The State Water Board; <br /> Regional Water Boards; and <br /> - A Local Implementing Agency which is responsible for overseeing <br /> corrective action at UST unauthorized release sites. <br /> MANAGEMENT OF THE EAR ACCOUNT <br /> The management of the EAR Account is the responsibility of the State Water <br /> Board. The DCWP Chief, has primary responsibility for the staff functions <br /> associated with management of the EAR Account. These management functions <br /> include: <br /> o Receive all requests for Iffittgency emergencycorrective action funds to take <br /> immediate action; <br /> o Approve or deny emergency requests for immediate funding ona case-by- <br /> case basis; <br /> o Receive all requests for corrective action funds to take prompt action; <br /> o Present prompt action requests to the State Water Board for their review <br /> and approval; <br /> o Survey the Regional Water Boards and LIAs to obtain an annual list of <br /> abandoned and recalcitrant sites where corrective action is required to <br /> protect human health, safety and the environment; <br /> o Establish a statewide priority list based on Regional Water Board <br /> recommendations with consideration of threat to human health, safety and <br /> the environment, and availability of funds; <br /> o Request the Regional Water Board Resolution used to adopt their annual <br /> prioritized list of abandoned and recalcitrant sites; <br /> -4- <br />
